ORDINANCE NO. 100, 1983
OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE AMENDING CHAPTER 118
OF THE CODE OF THE CITY OF FORT COLLINS_,
COMMONLY KNOWN AS THE ZONING ORDINANCE AND
CLASSIFYING FOR ZONING PURPOSES THE PROPERTY INCLUDED
IN THE EAST VINE DRIVE SEVENTH (7th)
ANNEXATION OF THE CITY OF FORT COLL.INS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the Zoning Ordinance District Map adopted by Chapter
118 of the Code of the City of Fort Collins be, and the same hereby is,
changed and amended by including the property known as the East Vine Drive
Seventh (7th) Annexation to the City of Fort Collins, Colorado, in the T, T
(Conditional ) and R-L-P Districts:
Tact "A" T (Conditional ) Zoning
All that part of the SW 1/4 of Section 5, Township 7 North,
Range 68 West of the 6th P.M. lying North of the Larimer & Weld
Ditch, containing 12.50 acres more or less;
and
The Northwest Quarter of Section 5, Township 7 North, Range 68
West of the 6th P.M. , together with two (2) shares of the
capital stock of the Water Supply and Storage Company, excep-
tion, however, all lands South of the Larimer and Weld Ditch and
railroad right-of-way;
and
A part of the NE 1/4 of Section 5, Township 7 North, Range 68
West of the 6th P.M. , described as follows: Commencing at the
NW corner of said 1/4 section, thence East 1756.10 feet, thence
South 2610.00 feet, thence West 1756 .10 feet, thence North
2610.00 feet to place of beginning; EXCEPT right-of-way deeded
by Quit Claim Deed recorded in Book 171, at Page 454, and EXCEPT
right-of-way of small lateral ditch as now constructed and
County Road; ALSO, all that portion of land in the SE 1/4 of
Section 5, Township 7 North, Range 68 West of the 6th P.M. ,
lying above the Larimer and Weld Canal ; ALSO a parcel of land in
the SW 1/4 of the NE 1/4 and NW 1/4 of the SE 1/4 of Section 5,
Township 7 North, Range 68 West of the 6th P.M. , described as
follows: Beginning at a point 30.00 feet East of the center of
said Section 5,. thence South 390.00 feet parallel to North and
South quarter line to the right-of-way of the Larimer and Weld
Canal , thence Easterly along right-of-way of said Canal 474.00
feet to a point 37.50 feet West of center line of the No. 8
Outlet Ditch, thence N 40°30'00" W 740.00 feet and parallel to
Outlet Ditch to a point 30.00 feet East of the North and South
quarter line, thence South parallel to quarter line 255.00 feet
to point of beginning; ALSO, commencing at the NE corner of said
Section 5, thence South 2610.00 feet, thence West 883.90 feet,
thence North 2610.00 feet, thence East 883.90 feet to place of
beginning, together with all water and water rights, and ditch
and ditch rights and two irrigations wells located thereon and
adjudicated as Nos. 144491 and 2972-F.
Subject to all rights-of-way, easements, and restrictions as now
in use and of record.
Said parcel contains 350 gross acres more or less.
Tract "B" T Zoning
A tract of land situate in the County of Larimer, State of
Colorado to-wit:
Two tracts of land situate in the Southwest 1/4 of Section 5,
Township 7 North, Range 68 West• e-f the 6th P.M. , which consi-
dering the South line of the said Southwest 1/4 as bearing N
89°36'37" W and with all bearings contained herein relative
thereto is contained within the boundary lines which begin at a
point on the West line of the said Southwest 1/4 which bears N
176.00 feet from the Southwest corner of said Section 5 and run
thence North 2957.41 feet along the said West line to a point
on the center line of the Larimer and Weld Canal ; thence S
53003'00" E 125.13 feet; thence South 3058.87 feet to a point on
the South line of the said Southwest 1/4; thence N 89036'37" W
50.00 feet; thence North 176.34 feet; thence West 50.00 feet to
the point of beginning AND ALSO beginning at a point on the
South line of the said Southwest 1/4 which bears S 89036'37" E
393.19 feet from the Southwest corner of said Section 5 and run
thence North 2840 .32 feet to a point on the centerline of
Larimer and Weld Canal ; thence along said centerline S 62011'00"
E 418.00 feet and again S 71°00'00" E 260.00 feet and again S
60030'00" E 389.00 feet and again S 54015'00" E 450.00 feet and
again S 62055'00" E 130.00 feet and again S 82°20'00" E 126.00
feet and again N 87°34'00" E 505.00 feet and again N 57°58'06" E
200.89 feet to a point on the East line of the said Southwest
1/4; thence S 00026'37" E 1873.59 feet along said East line;
thence N 89°36'37" W 300.00 feet; thence S 00°26'37" E 300.00
feet to a point on the South line of said Southwest 1/4; thence
N 89036 ' 37" W 470 .00 feet along said South line; thence N
00023' 23" E 596 .71 feet; thence N 89036 ' 37" W 146 .00 feet;
thence S 00023'23" W 82.22 feet; thence N 89036'37" W 254.00
feet; thence S 00023'23" W 514.49 feet to a point on the said
South line; thence N 89036'37" W 1080.53 feet along said South
line to the point of beginning.
Subject to all rights-of-way, easements, and restrictions
as now in use and of record.
Said parcel contains 123 gross acres more or less.

Tract "C" R-L-P Zoning
A tract of land situate in the County of Larimer, State of
Colorado to-wit:
The South 400.00 feet of the Southwest 1/4 of Section 32 ,
Township 8 North, Range 68 West of the 6th P.M.
Said parcel contains 24 gross acres more or less.
Section 2. That the zoning granted herein for Tract "A" acknow-
ledges that the nature of any farming and livestock feeding operation
is seasonal and would allow the property owners to continue at a level
not to exceed any previous historical maximum. The petitioners reserve the
right to continue livestock feeding not to exceed 400 head of cattle, 2,000
head of sheep and up to 4 horses as a condition of the approval of the
annexation and zoning. In addition, the property owners may add a machine
shed, the exact location of which is as' fet undetermined. The machine shed
of sheet metal , pole `construction will not exceed the dimensions of 72
feet by 40 feet.
Section 3. That the zoning granted herein is expressly conditioned
upon Tract "C" being developed as a planned unit development in accordance
with the Ordinances of the City of Fort Collins.
Section 4. That the City Engineer is hereby authorized and directed
to amend said Zoning District Map in accordance with this Ordinance.
Introduced, considered favorably on first reading, and ordered pub-
lished this 19th day of July, A.D. 1983, and to be presented for final
passage on the 16th day of August, A.D. 1983.
