OF THE COUNCIL OF THE CITY OF FORT COLLINS
PROVIDING FOR THE CREATION AND ORGANIZATION
OF THE LEMAY/HARMONY SPECIAL IMPROVEMENT DISTRICT No . 78
AND PROVIDING FOR THE CONSTRUCTION OF IMPROVEMENTS
THEREIN
-WHEREAS, the Council of the City of Fort Collins has received
and accepted petitions from affected property owners in the
proposed Lemav/Harmony Special Improvement District No . 78
requesting that proceedings be initiated to create said special
improvement district for the purpose of installing the
improvements described in the Engineering Report for the
Lemay/Harmony Special Improvement District on file with the City
Clerk for the benefit of the property described in said
Engineering Report; and
WHEREAS, the Council has received the necessary reports,
waived any notice pursuant to Section 16-38 of the Code of the
City of Fort Collins and received a written waiver signed by all
owners of the property in said improvement district and held a
hearing as required by the Code; and
WHEREAS , the affected property owners of said district have
expressly waived , in writing , any limitation on assessments for
the costs of installing said improvements pursuant to Section
16-20 of the Code of the City of Fort Collins; and
WHEREAS , the affected property owners shall enter into an
agreement with the City of Fort Collins concerning, without
limitation , the formation of the district, inclusion of special
district utilities, estimate of total cost, oversizing costs,
reimbursement for services rendered prior to formation of the
district , payment for improvements benefitting nonparticipating
properties and reimbursement therefor , credit for existing
improvements , method and payment of assessments and financing and
management of the project .
WHEREAS , the Council is of the opinion that it is in the best
interest of the public health , safety and welfare of the residents
of the City to form said special improvement district .
NOW, THEREFORE, BE .IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS:
Section 1 . That there is hereby created and organized an
improvement district under and by virtue of the provisions of
Chapter 16 of the Code of the City of Fort Collins , to be known as
the Lemay/Harmony Special Improvement District No . 78 (district )

comprised of the property described in Exhibit "A" attached
hereto.
Section 2 . That the improvements to be constructed shall
consist of the improvements described in the Enqineering Report
for the Lemay/Harmony Special Improvement District on file with
the City Clerk and as more fully set forth in the map, plans and
specifications heretofore submitted by the Director of Public
Works and accepted by the Council by resolution .
Section 3 . That the total estimated cost of such
improvements is $3, 039, 544.00 for all improvements to be installed
exclusive of the expense of collection, legal , advertising,
engineering, financing , interest during construction and other
incidental expenses . The total cost of the improvements together
with such expense of collection, legal , advertising, engineering ,
financing and other incidentals (not to exceed twenty-five per
cent ( 25% ) of the cost of such improvements ) and interest during
construction shall be assessed against the property in said
district as set forth on Exhibit "B" attached hereto and by this
reference made a part hereof and is further set forth in the
Engineering Report for the Lemay/Harmony Special Improvement
District on file with the City Clerk.
Section 4. That pursuant to Chapter 16 of the Code of the
City of Fort Collins , the Council has considered all complaints or
objections made and filed in writing by the owners of any real
estate to be assessed or any interested persons; and that the
Council further finds that all reauirements of the Code. of the
City of Fort Collins respecting the organization of the district
have been observed and compiled with in all respects; and it is
hereby ordered that the improvements in the district as provided
for in the maps, plans and specifications heretofore adopted by
the Council be and they hereby are ordered to be constructed.
Section 5. That the City Manager is authorized to enter into
an agreement with the property owners of the district providinq
for payments of oversizing costs , reimbursement for professional
services rendered prior to formation of the district , payment for
improvements benefitting nonparticipating properties and
reimbursement therefor , credit for existing improvements , method
and payment of assessments , financing and. management of the
district, default , termination and other necessary and incidental
terms thereof .
Section 6. That the City Manager is further authorized to
enter into an agreement with the property owners of the district
providing for management of the entire district construction
project by such owners including all bidding for work on the
project and awarding of contracts therefor, provided that a
competitive bidding process be used and provided further that

appropriate bonds be required of all contractors and
subcontractors performing work on the project .
Section 7. That when the improvements herein authorized have
been completed and the same approved and accepted by the City of
Fort Collins, the costs as set forth shall be assessed upon real
property in said improvement district, as set forth in Exhibit
"B" attached hereto and incorporated herein by this reference.
Section 8. That this ordinance shall be irrepealable until
the indebtedness hereby provided for, whenever the same shall be
created , shall have been duly paid , satisfied and discharged as
herein provided.

The improvements to be constructed- in the Special Imnrovement
District are as follows :
PHASE 1
Project A. Construction and surfacing of Lemay Avenue to a
width of thirty-six (36 ) feet from Harmony Road to Fossil Creek.
Project B. Construction and surfacing of Southridge Greens
Boulevard adjacent to property of The Archdiocese of Denver and
Fox Ridge II .
Project C. Construction and surfacing of remainder of
Southridge Greens Boulevard to its terminus in Southridge Greens ,
including all utility improvements , construction and surfacina of
Front Line Drive from Southridge Greens Boulevard to Mail Creek
Ditch, and construction and surfacing of Greenridge Parkway from
Southridge Greens Boulevard to its terminus in Southridge Greens .
Project D. Installation of water transmission main running
from Fossil creek Parkway to Lemay Avenue and continuing south on
Lemay Avenue for approximately 781 .38 lineal feet and 14"
waterline in Southridge Greens Boulevard from the intersection of
Lemay Avenue and Southridge Greens Boulevard running east
approximately 980 lineal feet .
Project E. Installation of all utilities crossing Southridge
Greens Golf Course;
Project F . Installation of offsite sewer line (Southridge
Greens to Trilby Road ) .
PHASE 2
Project G. Construction and surfacing of the south half of
Harmony Road to 3, 682 feet east of Lemay Avenue and to 11960 feet
west of Lemay Avenue;
Project H. widening of Lemay Avenue from Harmony to 1000
feet south of Harmony Road to a width of seventy feet ( 70 ' ) from "
flow line to flow line, including all construction and surfacing
therefor and installation of curb, gutter, sidewalk and other like
improvements .
Project I . Construction and surfacing of Oak Ridge Drive
from Lemay Avenue to Wheaton Drive; construction and surfacina of
Wheaton Drive from Harmony Road to Boardwalk; construction and
surfacing of McMurry Drive from Lemay Avenue to Wheaton Drive; and
construction and surfacinq of Boardwalk Drive from Lemay Avenue to
Wheaton Drive including all utility improvements therefor and;
Project J. Placement of a 20 inch waterline on Lemay Avenue

Project G: (Harmony)
Said property has a frontage on the portion of Harmony Road
to be improved of 842. 94 lineal feet and shall be assessed an
amount in proportion as the frontage of said property is to the
frontage of all property to be so improved exludinq rights-of-way
abutting such portion of Harmony Road , the costs for which shall
he proportionately assessed against each property owner within the
District boundaries .
Project H : (Lemay Oversizing )
Said property has 4 frontage of 968. 88 lineal feet on the
portion of Lemay Avenue to. be improved and shall he assessed for
the Lemay oversizing costs included in Project A an amount in
proportion as the frontage of said property is to the frontage of
all property to be so improved in Project H.
Project I : ( Interior Street/Utilities)
Said property has a frontage of 1985. 72 lineal .feet on Oak -
Rid,e Drive and shall be assessed an amount in proportion as the
frontage of said property is to the frontage of all property
fronting and abutting on Oak Ridge Drive .
Project J : ( 20 inch waterline )
Said property has a frontage of 1284 . 06 lineal feet on Lemay
Avenue in which the 20 inch waterline shall be placed and such
property shall be assessed an amount in proportion as the frontage
of said proeprty is to the frontage of all property to be so
improved with the 20 inch waterline in Lemay Avenue in Project J.

Said property and other property owned by Fver. itt Development
Company have a frontage on the portion of harmony Road to be
improved of 2488. 56 lineal feet , 452. 00 lineal feet of which is to
be included in the improvement district boundaries . Everitt
Development Company is assuming the assessment obligation for the
entire 2488 . 56 lineal feet of its frontage on the portion of
harmony Road to be improved and further Everitt Development
Company is assuming the costs for Harmony Road improvements for
Harmony Cemetery Association , whose property is not to be included
in the improvement district boundaries but which has a frontage on
the proposed Harmony Road improvements of 313 . 50 lineal feet .
Everitt Development Company ' s property shall therefore be
assessed for a total of 2802 . 06 lineal feet in an amount in
proportion as the total frontage of property to be assessed to

Ridqe Drive and shall be assessed an amount in proportion as the
front1-ig0 of 51-iid property is to the frontage of all property
fronting and abutting on Oak Ridqe Drive.
Said property additionally encompasses a portion of the
frontage of Wheaton Drive and shall. be assessed an amount equal to
twenty-five per cent ( 25% ) of the total cost for such
improvements .

for a total frontage of 1744 . 25 lineal feet which shall be
assessed an imount in proportion as the frontage of said property

rights-of-.way abutting such portion of Lemay Avenue , the costs for
which shall be proportionately assessed against each property
owner within the district boundaries with property abutting Lemay
Avenue.

Joint Venture is assuming one-half the costs of the Lemay
improvement for property fronting and abutting on Lemay Avenue
owned by Richard L. and Linda D. Rule which property has a total
frontage on Lemay of 413 .04 lineal feet .
Lake Sherwood Joint Venture 's property shall therefore be
assessed for a total of 1975. 88 lineal feet in an amount in
proportion as the total frontage . of property to be assessed to
Lake Sherwood Joint Venture is to the frontage of all property to
he so improved excluding rights-of-way abutting such portion of
Lemay Avenue , the cost for which shall be proportionately assessed
against each property owner within the District boundaries with
property abuttinq Lemay Avenue .
Phase 2
Project I : ( Interior streets and utilities)
Said property encompasses the entire frontage of both McMurry
and Boardwalk Drives and shall be assessed the entire cost of such
improvements .
Said property additionally encompasses a substantial portion
of the frontage of Wheaton Drive and shall be assessed an amount
equal to seventy-five per cent ( 75% ) of the total cost for such
improvements .

Said property shall be assessed the entire cost of the
waterline improvement from Fossil Creek Parkway to approximately
20 feet into the intersection of Southridge Greens Boulevard and
Lemay Avenue .
Further , Bucain Corporation is assuminq the cost for the
Fossil Creek Meadows Development property for the offsite
waterline in Lemav Avenue included in Project D which property has
a frontage of 691 . 36 lineal feet on Lemay Avenue . Such assessment
shall be in an amount in proportion as the frontage of Fossil
Creek Meadows Development ' s property is to the frontage of all
property on Lemay Avenue to be so improved with said waterline in
Project D.
A portion of Ducain Corporation 's pro.perty fronts and abuts
on Southridge Greens Boulevard and shall. be assessed an amount in
proportion as the frontage of such property is to the frontage of
all property fronting and abutting Southridge Greens Boulevard to
he so improved with the waterline in said boulevard .
Further , the Bucain Corporation is assuming the cost of the
waterline in Southridge Greens for the Archdiocese of Denver whose
property within the district includes a frontage of 785. 00 lineal
feet on Southridge Greens Boulevard , the assessment for which
shall he an amount in proportion as such frontage is to the
frontage of all property adiacent to Southridge Greens to be
improved with such waterline .
