OF THE COUNCIL OF THE CTTY-7 FORT COLLINS
PROVIDING FOR THE UNIFORM APPLICATION OF
INCOME CRITERIA FOR THE TAX REFUND PROGRAM
FOR THE ELDERLY, THE UTILITY REFUND PROGRAM
FOR THE ELDERLY AND CODE PROVISIONS RELATING
TO DEFERMENT OF ASSESSMENTS
WHEREAS, the Senior Citizens Board of the City of Fort Collins has
recommended that the income criteria in order to qualify for the utility
refund program for the elderly, the tax refund program for the elderly and
the Code provisions relating to the deferment of assessments be made
uniform and in conformity with the Colorado State Income Guidelines uti-
lized for real property tax credits/refunds and for fuel or heat expense
credit/refunds, and
WHEREAS, the utilization of the Colorado State Guidelines for real
property tax credits/refunds and fuel or heat expense credits/refunds will
provide more consistency and uniformity for the aforesaid municipal refund
and deferment programs, and
WHEREAS, the Council of the City of Fort Collins has determined that
the uniform application of the Colorado guidelines is in the best interest
of the citizens of the City of Fort Collins
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
Section 1 That Section 36-4 of the Code of the City of Fort Collins
be amended as follows
§36-4 Eligibility for Deferment
In order to be entitled to a deferment of assessments
under this Chapter , an applicafit, at the time of
application , must comply with the income limita-
tions as provided by the State of Colorado for real
property tax credits/refunds and fuel or heat expense
credits/refunds as particularly set forth in C R S
( 1973) 39-22-120 ( 3) and 39-22-124 ( 3) as amended
Section 2 That Section 106-3 (D) of the Code of the City of Fort
Collins be, and the same hereby is, amended to provide as follows
D The applicant must comply with the income limita-
tions as provided by the State of Colorado for real
property tax credits/refunds and fuel or heat
expenses credits/refunds as particularly set forth
in C R S ( 1973) 39-22-120 (3) and 39-22-124
(3) as amended
