OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE AMENDING SECTION 95-90
OF THE CODE OF THE CITY OF FORT COLLINS
RELATING TO THE COLLECTION OF STREET
OVERSIZING FEES
WHEREAS, in recognition of increasing costs and inflation, Section
95-91 of the Code of the city of Fort Collins provides for a quarterly
adjustment of oversizing fees to be made by the Director of Public Works,
and
WHEREAS, the 1981 construction costs for asphalt paving and concrete
work have been received from the contractors and developers, and
WHEREAS, said construction costs for residential and industrial
construction amount to approximately 14% more than last year's costs,
and
WHEREAS, deficiencies in regard to commercial construction necessi-
tates the separate establishment and clarification of the fee for such
commercial construction, and
WHEREAS, it is therefore necessary to adjust and establish the fees
set forth in Section 95-90 of the Code of the City of Fort Collins to
accurately reflect current costs
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
Section 1 That Section 95-90(A) of the Code of the city of Fort
Collins be, and it hereby is, amended by deleting the words and figures
"two hundred fifty-four dollars ($254 )" and substituting therefor the
words and figures "two hundred ninety dollars ($290 )"
Section 2 That Section 95-90(B) of the Code of the City of Fort
Collins be and it hereby is amended to read as follows
"B Industrial uses No building permit shall be issued for the con-
struction of any principal structure to be used for industrial
use until a fee in the amount of two thousand seven hundred fifty
dollars ($2,750 ) per gloss acre of the total parcel has been
paid to the Director of Finance "
Section 3 That Section 95-90 of the Code of the City of Fort Collins
be amended by the addition thereto of a new subsection to read as follows
"C Commercial and business uses and non-residential uses in the
commercial allotment for planned unit developments No building
permit shall be issued for the construction of any principal
structure to be used for commercial or business use (or non-resi-
dential use in the commercial allotment for planned unit develop-
ments) until a fee in the amount of three thousand five hundred
dollars ($3,500 ) per gross acre of the total parcel has been
paid to the Director of Finance "
Section 4 That Section 95-90 of the Code of the City of Fort
Collins be amenaed by the addition thereto of a new subsection to read
as follows
"D In the event that the building permit requested covers less than
the entire parcel , the Director of Public Works shall determine
the fee based upon the proportion of the property included in the
building permit to the entire parcel In the event of a joint
use, the higher cost use shall be applicable "
Section 5 That the remaining subsection in Section 95-90 be renum-
bered accordingly
Introduced, considered favorably on first reading, and ordered pub-
lished this 15th day of September, 1981, and to be presented for final
passage on the 6th day of October, 1981
