OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION
SERVICES FUND AND AUTHORIZING THE TRANSFER OF EXISTING
APPROPRIATIONS IN THE TRANSPORTATION SERVICES FUND AND
THE GENERAL FUND TO BE USED FOR THE DESIGN AND
CONSTRUCTION OF EAST MOUNTAIN TROLLEY TRACK ENHANCEMENTS
WHEREAS,the City's history of public transportation dates back to 1907 when the Denver
and Interurban Railroad, a subsidiary of the Colorado and Southern Railroad, built the City's first
streetcar line; and
WHEREAS, the City operated its streetcar lines, which fanned out from the intersection of
College and Mountain Avenues, from 1907 to 1951 and removed them from service in favor of
modern buses; and
WHEREAS the City's historic trolley system stem has been restored on West Mountain Avenue
but no plans have been made to restore the line east across College Avenue because of the difficulty
in crossing Burlington Northern & Santa Fe railroad right-of-way; and
WHEREAS,there are several sections of trolley brick and light rail exposed to view east of
College Avenue that are severely deteriorated, uneven and unsightly after almost 100 years in the
street; and
WHEREAS, the City has applied for and received a grant from the North Front Range
Metropolitan Planning Organization Transportation Enhancement Grant Program in the amount of
$107,640 to restore the brick roadbed surrounding the streetcar railway track along East Mountain
Avenue,between College Avenue and Peterson Street (the"Project"); and
WHEREAS, preservation of this architectural remnant of the City's streetcar system will
enhance the historic ambiance of the plaza entrance to Historic Old Town Fort Collins and provide
safe passage for pedestrians and bicycles over the brick roadbed along Mountain Avenue; and
WHEREAS, the scope of the Project includes removing and reinstalling existing brick,
adding some new brick, and replacing concrete pavement with bricks east of College Avenue to
Peterson Street on Mountain Avenue; and
WHEREAS,the estimated cost of the Project is$134,550,and requires local matching funds,
totaling $26,910; and
WHEREAS, the source of matching funds are identified as follows:
Downtown Development Authority- Existing Appropriations $10,000
Transportation Services Fund - Existing Appropriations $10,000
General Fund - Existing Appropriations 6,910
Total $ 26,910
WHEREAS,on February 20,2007,City Council adopted Resolution 2007- authorizing the
Mayor to execute an intergovernmental agreement with the Colorado Department of Transportation
for the design and construction of enhancements to the trolley tracks on East Mountain Avenue;and
WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of North Front Range
Metropolitan Planning Organization Transportation Enhancement Grant Program grant funds will
not cause the total amount appropriated in the Transportation Services Fund-East Mountain Avenue
Trolley Track Enhancements project to exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital
project to another fund or capital project,provided that the purpose for which the transferred funds
are to be expended remains unchanged; and
WHEREAS,it is the desire of the Council to appropriate the sum of$107,640 in North Front
Range Metropolitan Planning Organization Transportation Enhancement Grant Program grant funds
and$10,000 in the form of a payment from the Downtown Development Authority, and authorize
the transfer of appropriations, totaling $10,000, from the Transportation Services Fund 2007
operating budget and $6,910 from the General Fund to the Transportation Services Fund - East
Mountain Avenue Trolley Track Enhancements project for preservation of the trolley tracks along
East Mountain Avenue, between College Avenue and Peterson Street.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in
the Transportation Services Fund-East Mountain Avenue Trolley Track Enhancement project,the
sum of ONE HUNDRED SEVEN THOUSAND SIX HUNDRED FORTY DOLLARS ($107,640)
representing grant proceeds from the North Front Range Metropolitan Planning Organization
Transportation Enhancement Grant Program, to be used for the preservation of the trolley tracks
along East Mountain Avenue, between College Avenue and Peterson Street.
Section 2. That there is hereby appropriated for expenditure from unanticipated revenue in
the Transportation Services Fund-East Mountain Avenue Trolley Track Enhancement project,the
sum of TEN THOUSAND DOLLARS ($10,000), representing a payment from the Downtown
Development Authority, to be used for the preservation of the trolley tracks along East Mountain
Avenue,between College Avenue and Peterson Street.

Section 3. That the unexpended appropriated amount of TEN THOUSAND DOLLARS
($10,000) is hereby authorized for transfer from the Transportation Services Fund 2007 operating
budget to the Transportation Services Fund - East Mountain Avenue Trolley Track Enhancement
project to be used for the preservation of the trolley tracks along East Mountain Avenue,between
College Avenue and Peterson Street.
Section 4. That the unexpended appropriated amount of SIX THOUSAND NINE
HUNDRED TEN DOLLARS($6,910)is hereby authorized for transfer from the General Fund 2007
operating budget to the Transportation Services Fund - East Mountain Avenue Trolley Track
Enhancement project to be used for the preservation of the trolley tracks along East Mountain
Avenue, between College Avenue and Peterson Street .
Introduced, considered favorably on first reading, and ordered published this 20th day of
