OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE GRANT OF A NON-EXCLUSIVE EASEMENT
AND RIGHT-OF-WAY TO PLATTE RIVER POWER AUTHORITY
FOR CONSTRUCTION AND MAINTENANCE OF A 230KV TRANSMISSION LINE
WHEREAS, the City of Fort Collins is the owner of certain real property known as the
Colina Mariposa Natural Area("Natural Area") located at Section 14 T6N R69W in Larimer
County, Colorado; and
WHEREAS, Platte River Power Authority("Platte River") is a municipal electric utility
responsible for meeting the wholesale electric energy requirements of Fort Collins, Loveland,
Longmont, and Estes Park; and
WHEREAS, Platte River has determined that its existing transmission system has been
reliable for the last 20 years but that the system requires upgrading in order to support future
growth and load demands of the municipalities to which it provides wholesale electric energy;
and
WHEREAS, Platte River originally proposed to utilize an overhead transmission line
throughout the upgraded system but, in considering the proposed overhead line, the City Council
expressed concerns regarding the visual impacts the overhead line would likely have on the
Natural Area; and
WHEREAS, Platte River has responded to these concerns by redesigning its project so as
to underground the transmission line as it crosses the Natural Area; and
WHEREAS, Platte River will pay for the construction and burial of the underground
transmission line; and
WHEREAS, Platte River has requested that the City grant a 25-foot permanent
nonexclusive easement and right of way(the 'Permanent Easement") for the construction and
maintenance of the underground transmission linethrough the Natural Area in the general
location described and shown in Exhibit "A" attached hereto and incorporated herein by this
reference (the "Permanent Easement Area"); and
WHEREAS, Platte River has requested that the City grant a 35-foot wide temporary
construction easement (the "Temporary Easement") for the construction of the underground
transmission line, which will cross the Natural Area in a general location adjacent to the
Permanent Easement; and
WHEREAS, the overall width of both the Temporary and Permanent Easements will not
exceed 65 feet(the "Temporary Easement Area"); and
WHEREAS, City staff has negotiated with Platte River and Platte River has agreed to pay
the fair market value of the Permanent Easement and Temporary Easement (which includes
restoration fees) in the total amount of$49,000; and
WHEREAS, the Natural Resources Advisory Board reviewed a conceptual
easement request at its work session meeting on October 19, 2005, and board discussion
supported the proposal; and
WHEREAS, on July 12, 2006, the Land Conservation and Stewardship Advisory Board
reviewed the originally proposed project and easement and decided to recommend that the
easement be allowed; and
WHEREAS, the Land Conservation and Stewardship Advisory Board and City Staff have
concluded that the alignment of the new transmission line through the Natural Area is the only
reasonable alignment of the transmission line; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of an interest in real property owned by the City, provided
the Council first finds by ordinance that any sale or disposition of that real property interest will
be for the benefit of the City's citizens, and will be in the best interests of the City.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
That the Council hereby finds that the ant of the Permanent Easement
Section 1. y grant
and the Temporary Easement as described herein will be in the best interests for the City of Fort
Collins.
Section 2. That the Mayor is hereby authorized to execute such documents of
conveyance as are necessary for the City to convey the Permanent Easement and Temporary
Easement as described herein, together with such terms and conditions as the City Manager, in
consultation with the City Attorney, determines to be necessary or appropriate to protect the
interests of the City.
