OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND -
BUILDING ON BASICS - INTERSECTION IMPROVEMENTS AND TRAFFIC SIGNALS
CAPITAL PROJECT FOR THE DESIGN AND CONSTRUCTION OF IMPROVEMENTS
TO THE HARMONY ROAD AND COLLEGE AVENUE INTERSECTION
WHEREAS, the intersection of College Avenue and Harmony Road is one of the highest
volume intersections in the City, constrained on all four comers by existing development; and
WHEREAS,the aforementioned intersection currently operates at a Level of Service D(50
seconds average delay) and is forecast to be Level of Service F (95 seconds average delay) within
20 years; and
WHEREAS, design and construction improvements at the intersection of Harmony Road
and College Avenue(the"Project"), will reduce traffic delays, improve the pavement surface,
and provide safer facilities for bicycles and pedestrians; and
WHEREAS, design work on the Project will begin in 2008 with right-of-way acquisition
starting in 2009, and construction in 2010; and
WHEREAS,the Colorado Department of Transportation("CDOT")administers the federal
Congestion Mitigation and Air Quality Improvement ("CMAQ") grant program, a program that
supports local transportation projects that improve ambient air quality and attainment or maintenance
of compliance with the air quality standards of the federal Clean Air Act; and
WHEREAS, CDOT has awarded the City a CMAQ grant for the design, right-of-way
acquisition and construction of improvements of the Project; and
WHEREAS,the CMAQ grant is for$1,200,000 in addition to$220,000 in State of Colorado
funds; and
WHEREAS, as part of receiving the grant, the City is required to provide local matching
funds, totaling$249,450; and
WHEREAS, staff recommends using existing appropriations in the Capital Projects Fund-
Building on Basics - Intersection Improvements and Traffic Signals capital project to fund the
required local match; and
WHEREAS, the City Council adopted Resolution 2008-012, on February 19, 2008,
authorizing the Mayor to enter into an intergovernmental agreement with CDOT for the receipt of
CMAQ funds to be used for the design and construction of improvements to the Project; and
WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the CMAQ grant funds
($1,200,000), administered through the Colorado Department of Transportation, and funding from
the State of Colorado($220,000),will not cause the total amount appropriated in the Capital Projects
Fund-Building on Basics-Intersection Improvements and Traffic Signals capital project to exceed
the current estimate of actual and anticipated revenues to be received during the fiscal year; and
WHEREAS, it is the desire of the Council to appropriate the sum of$1,200,000 in grant
funds and$220,000 in funds from the State of Colorado, in the Capital Projects Fund- Building on
Basics - Intersection Improvements and Traffic Signals capital project to be used to with existing
appropriations, totaling $249,450, for design and construction of improvements to the Project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund-Building on Basics- Intersection Improvements and Traffic Signals capital
project the sum of ONE MILLION FOUR HUNDRED TWENTY THOUSAND DOLLARS
($1,420,000) from the following sources:
Colorado Department of Transportation Congestion Mitigation
and Air Quality Improvement funds $ 1,200,000
State of Colorado funds 220,000
Total $ 1,420,000
to be used to with existing appropriations, totaling $249,450, for design and construction of
improvements to the Harmony Road and College Avenue intersection.
Introduced, considered favorably on first reading, and ordered published this 19th day of
February, A.D. 2008, and to be presented for final passage on t th day of March, A.D. 008.
