ORDINANCE NO. 46 , 1984
OF THE COUNCIL OF THE CITY OF FORT COLLINS,
BEING AN ORDINANCE AMENDING CERTAIN SECTIONS
OF THE LAND DEVELOPMENT GUIDANCE SYSTEM TO
INCLUDE SOLAR ACCESS PLANNING CRITERIA
WHEREAS, it is essential to insure future solar access to the citizens
of the City of Fort Collins; and
WHEREAS, it is necessary to adopt performance criteria to prohibit the
location of landscaping and structures on Planned Unit Development (PUD)
sites which would shade adjacent lots; and
WHEREAS, one of the most easily calculable methods to control the
amount of shading is use of the "hypothetical wall" ; and
WHEREAS, it is desirable that criteria be adopted to protect solar
energy systems and rooftop surfaces in the PUD from being blocked from the
sun' s energy.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 118-83(D) of the Land Development Guidance
System,ATTDevelopment Numbered Criteria 30 through 44 be renumbered
in consecutive numbers 32 through 46.
Section 2. That Section 118-83(D) of the Land Development Guidance
System, A 1 evelopment Numbered Criteria, be and the same hereby is
adopted in numerical sequence as follows:
30. Are the elements of the site plan, e.g. buildings, circula-
tion, open space, and landscaping, located and designed so as
not to cast a shadow onto adjacent property greater than a
shadow cast by a twenty-five (25) foot hypothetical wall
located along the property lines of the project between the
hours of 9:00 AM and 3:00 PM, MST on December 21st?
Section 3. That Section 118-83(D) of the Land Development Guidance
System, ATT Development Numbered Criteria, be and the same hereby is,
adopted as follows:
31. Are the elements of the site plan, e.g. buildings, circula-
tion, open space, and landscaping, located and designed to the
the extent feasible to protect access to sunshine for planned
solar energy systems and/or for solar oriented rooftop sur-
faces which can support a solar collector or collectors
capable of providing for the anticipated hot water needs of
the building in the project between the hours of 9:00 AM and
3:00 PM, MST On December 21st?
Introduced, considered favorably on first reading, and ordered pub-
lished this 3rd day of April , A.D. , 1984, and to be presented for final
passage on the 17th day of April A.D. , 1984.
