OF THE COUNCIL OF THE CITY OF FORT COLLINS
ESTABLISHING THE SCHOOL SITE ACQUISITION FEE
WHEREAS, the three school districts in Larimer County (P k School
District R-3, Poudre School District R-1, and Thompson Scho District
R2-J) have requested the City of Fort Collins and other citi in Larimer
County, together with Larimer County, collect for such sch ols a school
site land dedication or acquisition fee to be assessed or residential
development within Larimer County; and
WHEREAS, such land dedication or school fee is pro osed to be imposed
by the City of Fort Collins before the issuance of a b ilding permit for a
residential use; and
WHEREAS, the school districts have demons rated that such land
dedication or fees are necessary to reduce a d offset the impact of
increased school enrollments; and
WHEREAS, the land dedication or the colle ion of such fee by the City
will promote the interest of the health, saf ty and general welfare of the
citizens of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY HE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
1. Any applicant requesting a building permit for residential
purposes shall , prior to receipt o such building permit, dedicate to the
appropriate School District land proved by the School District for school
use as established herein or ay a fee to the City in lieu of land
dedication as follows:

Multi family nit: .0114 acre or $136.80
2. Any mo ies collected by the City of Fort Collins of the fees
described here' shall be paid over to the appropriate school district
within three onths after the collection of such fee. Payment to the
appropriate school district shall be made pursuant to intergovernmental
agreement hich shall provide that the monies shall be expended by the
appropri to school district for school site acquisition within the Fort
Collin Urban Growth Area. Such Intergovernmental Agreement shall also
cont n provisions requiring the school district to hold the City harmless
in a event that the City suffers injury or loss by reason of the adoption
o enforcement of this Ordinance.

3. The effective date of this Ordinance shall be August 1, 1985.
Introduced, considered favorably on first reading, and ordered
published this 21st day of May , A.D. 1985, and to be presented for
final passage on the 4th day of June A.D. 1985.
