OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO SIGN AN INTERGOVERNMENTAL
AGREEMENT CREATING AN EMERGENCY TELEPHONE SERVICE
AUTHORITY IN ORDER TO ESTABLISH AND OPERATE AN
EMERGENCY TELEPHONE SERVICE SYSTEM IN THE
CITY OF FORT COLLINS, IMPOSING AN EMERGENCY
TELEPHONE CHARGE UPON TELEPHONE EXCHANGE
ACCESS FACILITIES WITHIN THE CITY OF
FORT COLLINS AND AUTHORIZING SERVICE
SUPPLIERS TO COLLECT SAID
EMERGENCY TELEPHONE CHARGES
WHEREAS, in the interest of protecting and preserving public safety
and welfare, it is desirable that the citizens of the City of Fort Collins,
Colorado, be provided with emergency telephone service to aid the timely
provision of emergency service; and
WHEREAS, Article 11 of Title 29, C.R.S. , authorizes the City to take
such actions as may be necessary for the acquisition of equipment,
provision of services and operation of an emergency telephone service to
pay costs incurred therefore through the imposition of an emergency
telephone charge and require that such charges be stated separately in the
billing and be collected by the telephone service supplier; and
WHEREAS, Articles 1 and 11 of Title 29, C.R.S. , authorize the City to
contract with other governmental agencies to establish a separate legal
entity to provide for the joint exercise of lawfully authorized activities
and, in particular, for the administration of this emergency telephone
service; and
WHEREAS, such a system would be in the best interests of the City of
Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1 . The Mayor is authorized to enter into an intergovernmental
agreement with other governing bodies located within Larimer County,
Colorado, to create the Larimer Emergency Telephone Authority in order to
establish and maintain an emergency telephone service system offering
enhanced 911 capability in the County of Larimer, Colorado.
Section 2. Every telephone service user shall pay monthly to the
telephone service supplier, who shall remit the same to the Larimer
Emergency Telephone Authority, a telephone exchange access facility charge
of two percent (lye) of the tariff rate established by the Public Utilities
Commission or fifty cents ($.50) per month per exchange access facility,
whichever is less.
Section 3. Upon recommendation of the Larimer Emergency Telephone
Authority, the City Council may, by resolution, raise or lower the
telephone exchange access facility charge, except, however, that such
charge shall not exceed two percent (2%) of the tariff as approved by the
Public Utilities Commission.
Section 4. Telephone service suppliers providing telephone service in
the City of Fort Collins are hereby authorized to collect the emergency
telephone charge imposed by this ordinance in accordance with Section
29-11-101, C.R.S.
Section 5. This ordinance shall not be effective until the
intergovernmental agreement creating the Larimer Emergency Telephone
Authority and concerning the implementation of an emergency telephone
service system is signed by representatives of all parties to the
agreement.
Section 6. This ordinance is adopted pursuant to Article 11 of Title
29, C.R.S. , to carry out the purposes of that Article and shall be
interpreted and administered consistently with Article 11.
