OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF 226 WEST MOUNTAIN AVENUE,
FORT COLLINS, COLORADO
WHEREAS, the City of Fort Collins, Colorado ("the City") , and the County
of Larimer, Colorado ("the County") , jointly own the property located at 226 West
Mountain Avenue, Fort Collins, Colorado ("the Property") ; and
WHEREAS, Khalil Kamandy has proposed to lease the Property from the City
and the County for the principal purpose of operating a restaurant; and
WHEREAS, the City and County desire to enter into this lease in order to
generate revenue from the Property; and
WHEREAS, the Lease Agreement is scheduled to be considered by the County
Commissioners of the County on May 29, 1991; and
WHEREAS, Section 23-114 of the Code of the City requires that the Council
find the Lease Agreement with Khalil Kamandy is in the best interests of the
City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the proposed lease of the Property is in the best
interests of the City of Fort Collins.
Section 2. That the Mayor be, and she hereby is, authorized to enter into
a Lease Agreement with Khalil Kamandy for the Property, subject to approval by
the County, which provides for the following:
A guaranteed rental term of three (3) years for the Property with
an option to renew the lease for an additional two (2) year term
with a base monthly rental of Seven Hundred Eight Dollars ($708.00)
per month and with Khalil Kamandy obligated to pay the costs of
water, sewer, gas and property taxes used on or assessed against
the Property.
Introduced, considered favorably on first reading, and ordered published
this 4th day of June, A.D. 1991, and to be presented for final passage on the
2nd day of July, A.D. 1991 .
