OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING ORDINANCE NO. 158, 1986 TO DELETE
SECTIONS PERTAINING TO THE BUILDING BOARD OF APPEALS
AND THE BUILDING CONTRACTORS LICENSING BOARD,
AND CREATING A BUILDING REVIEW BOARD
WHEREAS, the City Council created the Building Board of Appeals for
the purpose of reviewing alternate materials and methods of construction,
making interpretations of the City Building Codes, and hearing appeals of
all matters under the Board's jurisdiction; and
WHEREAS, the City Council created the Building Contractors Licensing
Board for the purpose of reviewing applications for contractor licenses,
revoking and suspending licenses, and hearing all other matters pertaining
to proper administration of the Code; and
WHEREAS, at its April 21, 1987 meeting, Council directed staff to
investigate and combine the duties of the aforesaid boards.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Ordinance No. 158, 1986 is amended to delete all
sections pertaining to the Building Board of Appeals.
Section 2. That Ordinance No. 158, 1986 is amended to delete all
sections pertaining to the Building Contractors Licensing Board.
Section 3. That the following sections creating the Building Review
Board be added to Chapter 2 of the Code of the City of Fort Collins and
numbered sequentially:
Building Review Board
§2 Creation.
There shall be and is hereby created a Building Review Board,
hereafter called the "board" .
§2-_. Membership; term.
The board shall consist of seven (7) regular members and two (2)
alternate members appointed by the City Council , three (3) of whom
shall be qualified by experience and/or training to knowledgeably
consider technical matters related to building construction.
Appointments shall specify the term of office of each member in order
to achieve overlapping tenure. Each member shall serve a term of four
(4) years without compensation. Alternate members shall serve terms
of two (2) years without compensation. All members shall be subject
to removal by the City Council . If a vacancy occurs on the board, it
shall be filled by the City Council for the remaining unexpired
portion of the term.
§2 Fun.,Lions.
The board shall determine the suitability of alternate materials
or alternate methods of construction, provide for reasonable
interpretations of the provisions of the City Building Code, City
Mechanical Code, City Plumbing Code, City Electrical Code, and City
Fire Code, and hear all appeals made to it related to such codes. In
addition to said duties, the board shall also review all applications
for any contractor license or certificate as outlined in Chapter 73,
Article XVII of this Code in order to determine whether such
applicants are qualified by experience and training to perform
building construction or supervision of such in the City, and hear all
matters related to the suspension or revocation of any said
certificate or license or registration of any plumber or electrician
as specified in this Code.
§2-_. Officers; bylaws.
The board shall elect annually from its membership a chairperson
and such other officers as may be required. Bylaws may be adopted by
the board, which bylaws shall not be inconsistent with the Charter and
the Code. A copy of the bylaws shall be filed with the City Clerk for
the use of the City Council immediately after adoption by the board,
and the same may be subject to the approval of the City Council .
§2-_. Minutes; annual report.
It is required that minutes be kept for each board meeting and
that such minutes be filed with the City Clerk prior to the next
regular meeting of the board. On or before January 31 of each year,
the board shall file a report with the City Clerk setting forth the
activities of the board for the previous year.
Section 4. That all references to the Building Board of Appeals and
the Building Contractors Licensing Board in the Code of the City of Fort
Collins shall henceforth be referred to as the Building Review Board.
Introduced, considered favorably on first reading, and ordered
published this 2nd day of June, A.D. 1987, and to be presented for final
