HomeMy WebLinkAbout172 - 01/03/2006 - AMENDING CHAPTER 26 OF THE CITY CODE TO REVISE SEWER PLANT INVESTMENT FEES ORDINANCE NO. 172, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 26 OF THE CODE OF THE CITY OF FORT COLLINS TO REVISE SEWER PLANT INVESTMENT FEES WHEREAS, the City Council is empowered and directed by Article XII, Section 6, of the Charter of the City of Fort Collins, Colorado, to by ordinance from time to time fix, establish, maintain and provide for the collection of such rates, fees or charges for utility services furnished by the City as will produce revenues sufficient to pay the costs, expenses and other obligations of the wastewater utility, as set forth therein; and WHEREAS, the City Council adopted Ordinance No. 134, 2005 on November 15, 2005, which revised 2006 sewer plant investment fees; and WHEREAS, the intent of Ordinance No. 134, 2005 was to phase in the sewer plant investment fees over a three year period; and WHEREAS, in order to phase in the fees for high strength users, the flows must also be phased in; and WHEREAS,when Ordinance No. 134,2005 was drafted and approved,the flows were not adjusted to phase in the fees but, instead, flow amounts reflected full implementation of the 2005 plant investment fee study; and WHEREAS,staff recommends that flows be adjusted to reflect Council's intent to phase in one-third of the fee increase; and WHEREAS,based on the foregoing, it is the desire of the City Council to amend Chapter 26 of the City Code to revise flows used to calculate sewer plant investment fees for high strength customers. NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That Section 26-284(f) of the Code of the City of Fort Collins is hereby amended to read as follows: Sec. 26-284. Sewer plant investment fees and surcharges established. (f) For purposes of this § 26-284, the proportionate share of peak day flow at the treatment plant for users in categories D, E and F shall be deemed to be: Water meter size Peak flow (inches) (gallons per day) 3/s 550 1 1,418 1%a 2,680 2 4,345 3 9,082 4" and Greater Calculated on an individual basis based on user's proportionate share of peak day flow at the treatment plant(including both contributed wastewater volume and volume related to infiltration and inflow) but not less than the peak day flow for a three (3) inch meter.
