OF THE COUNCIL OF THE CITY OF FORT COLLINS
DESIGNATING PROPERTY WITHIN THE CITY OF FORT COLLINS
AS AN HISTORIC LANDMARK DISTRICT PURSUANT
TO CHAPTER 14 OF THE CODE OF
THE CITY OF FORT COLLINS
WHEREAS, a preliminary investigation by the Landmark Preservation
Commission of the City of Fort Collins indicated that the structures known
as the Avery House and the Avery Carriage House (located at 328 W. Mountain
Avenue and 108 N. Meldrum Street respectively) and the lands on which said
structures are located which lands are described as follows, to wit:
A tract of land located in Block 41 of the Original City of Fort
Collins, Larimer County, Colorado, more particularly described as
follows;
Considering the East right-of-way line of Meldrum Street, being a
line between the southwest corner of the said Block 41 (being a
found No. 6 rebar) and the northwest corner of the said "Carriage
House" property (being a found No. 5 rebar) as bearing North
00°00'00" East and with all bearing contained herein relative
thereto;
Commencing at the said southwest corner of Block 41, also being
the TRUE POINT OF BEGINNING of this description; thence along the
said east right-of-way line, North 00°00'00" East 192.50 feet to
a line which is 17.50 feet (measured at right angles) north of
and parallel with the southerly line of Lot 24 of the said Block
41 , (as now monumented) ; thence along the said parallel line,
North 89051'45" East 75.00 feet; thence South 00°00'00" East
17.50 feet to the south line of the said Lot 24; thence along the
said south line of Lot 24, North 89051'45" East 87.38 feet to
the northerly prolongation of the east line of the West 12.50
feet of Lot 28 of the said Block 41, (as now monumented) ; thence
along the said prolongation and along the said east line, South
00'00'00" West 175.00 feet to the North right-of-way of Mountain
Avenue; thence along the said north right-of-way, South 89'51 '45"
West 162.38 feet to the point of beginning.
are eligible for designation as an Historic Landmark District due to their
architectural and historical significance to the community; and
WHEREAS, the City of Fort Collins has acquired ownership of the Avery
House and the Avery Carriage House for the purpose of historic preservation
of those structures and related grounds and features; and
WHEREAS, the Avery Carriage House has historic significance in
relation to the other buildings, structures and lands that would comprise
the Avery House Historic District; and
WHEREAS, the Landmark Preservation Commission held a public
designation hearing on April 4, 1990; and
WHEREAS, pursuant to said public hearing, the Landmark Preservation
Commission recommended to the Council of the City of Fort Collins that the
properties containing the Avery House and Avery Carriage House be
designated as an Historic Landmark District pursuant to Chapter 14 of the
Code of the City of Fort Collins; and
WHEREAS, the site and environs of the Avery House and the Avery
Carriage House portray a time and place important to the physical and
social development and history of Fort Collins; and
WHEREAS, the establishment of the Avery House Historic District would
provide to the public an example of the early setting, architectural style
and manifestations of Fort Collins; and
WHEREAS, the City Council has determined that the proposed Avery House
Historic District meets the criteria of a landmark district as set forth in
Section 14-5 of the Code and is eligible for designation as a landmark
district.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1 . That the structures known as the Avery House and the Avery
Carriage House, together with the lands described above, upon which said
structures are located, be, and hereby are, designated as an Historic
Landmark District pursuant to Chapter 14 of the Code of the City of Fort
Collins.
Section 2. That the said properties will be known as the Avery House
Historic District.
Section 3. That the Secretary of the Interior Standards for
Rehabilitation and Guidelines for Rehabilitating Historic Buildings (U. S.
Department of the Interior, National Park Service, Revised 1983) shall
serve as the standards by which alterations, additions and other changes to
the Historic District will be reviewed for compliance with Chapter 14,
Article III of the Code of the City of Fort Collins.
Section 4. That the designation of said district shall not be
construed to require the consent of the Landmark Preservation Commission
for such landscaping or other work on the grounds of the district which is
necessary as part of normal landscape and grounds maintenance and repair.
Introduced, considered favorably on first reading, and ordered
published this 15th day of May, A.D. 1990, and to be presented for final
passage on the 5th day of June, A.D. 1990.E
