OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 5
OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE
REGULATION AND CONTROL OF THE DESIGN, CONSTRUCTION, INSTALLATION,
QUALITY OF MATERIALS, AND LOCATION OF ELECTRICAL EQUIPMENT AND
WIRING METHODS IN THE CITY OF FORT COLLINS, ADOPTING BY
REFERENCE HERETO THE NATIONAL ELECTRICAL CODE, 1993 EDITION
OF THE NATIONAL FIRE PROTECTION ASSOCIATION, AND THE
UNIFORM ADMINISTRATIVE CODE PROVISIONS FOR THE NATIONAL
ELECTRICAL CODE, 1993 EDITION OF THE INTERNATIONAL CONFERENCE
OF BUILDING OFFICIALS AND SETTING FORTH CERTAIN AMENDMENTS TO SAID CODE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 5
of the Cade of the City of Fort Collins be amended as follows:
Section 1. That Section 5-80 is repealed and reenacted to read as follows:
Sec. 5-80. Adoption of standards.
Pursuant to the power and authority conferred on the City Council
by Section 31-16-202, C.R.S. , and Article II, Section 7 of the
Charter, there is hereby adopted for the protection of the public
health and safety, and for the purpose of regulating the
installation, alteration, repair of electrical systems and wiring
methods in the city, as the electrical code of the city, by
reference thereto, the National Electrical Code, 1993 Edition,
published by the National Fire Protection Association, and the
Uniform Administrative Code Provisions for the National Electrical
Code, 1993 Edition, published by the International Conference of
Building Officials, all to have the same force and effect as if set
forth herein in every particular.
Section 2. That Sections 5-82 and 5-84 are repealed and reenacted to read
as follows:
Sec. 5-82. Amendments to code adopted.
(1) Section 203 of the Uniform Administrative Code
Provisions for the National Electrical Code, 1993
Edition, is amended to read as follows:
"Sec. 203. Whenever the Administrative Authority
disapproves an application or refuses to grant a permit
applied for or it is claimed that the provisions of the
National Electrical Code do not apply or that the true
intent and meaning of the code has been misconstrued or
wrongly interpreted, the applicant or party in interest
may appeal such decision to the State Electrical Board
as provided for in Section 12-23-104(g) , C.R.S. "
(2) Section 304(a) of the Uniform Administrative Code
Provisions for the National Electrical Code, 1993
Edition, is amended to read as follows:
"The fee for each permit shall be based on the value of
the work regulated herein, as set forth in 'Table No. 3-
A Building Permit Fees, ' of the Building Code of the
city, except that such fee shall not be less than
fi . teen dollars ($15) nor exceed ti.., amount prescribed
by Section 12-23-117, C.R.S."
Sec. 5-84. Violations and penalties.
Section 204 of the Uniform Administrative Code Provisions for the
National Electrical Code, 1993 Edition, is amended to read as
follows:
"Sec. 204. It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair, move,
improve, remove, convert or demolish, equip, use or maintain an
electrical system or equipment or cause or permit the same to be
done in violation of this Code. Any person, firm or corporation
violating any of the provisions of this Code shall be deemed guilty
of a misdemeanor and subject to the penalties set forth in Section
1-15 of the Code of the city."
Section 3. That Sections 5-85, Schedule of Inspections; 5-86,
Reinspections; and 5-87, Appeals from decisions of enforcing official , are
repealed in their entirety.
Section 4. That the repeal and reenactment of Sections 5-80, 5-82 and 5-84
and the repeal of Sections 5-85, 5-86 and 5-87 shall not make lawful any
violation of the ordinances hereby repealed occurring before the effective date
hereof, and provided further that the construction under any building permit
heretofore taken out under the ordinance herein repealed may be continued in
conformance with such repealed ordinance or, if the owner thereof elects, in
conformity with the ordinance herein enacted.
