HomeMy WebLinkAbout092 - 09/15/1992 - AMENDING CITY CODE PERTAINING TO BOARDS AND COMMISSIONS ORDINANCE NO. 92, 1992 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING CERTAIN AMENDMENTS TO VARIOUS CHAPTERS OF THE CODE OF THE CITY OF FORT COLLINS PERTAINING TO CITY BOARDS AND COMMISSIONS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That Chapter 2, Division 5, Board of Trustees of the Police Officers' Pension Plan, of the Code of the City is hereby repealed and reserved. Section 2. That Chapter 2, Division 6, Building Review Board, Section 2- 102 and Section 2-105, of the Code of the City is hereby amended to read as follows: Sec. 2-102. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council , three (3) of whom shall be qualified by experience and/or training to knowledgeably consider technical matters related to building construction. (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-105. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 3. That Chapter 2, Division 8, Cable TV Board, Section 2-137 and Section 2-140, of the Code of the City is hereby amended to read as follows: Sec. 2-137. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council . A representative of Columbine Cablevision shall serve as an ex officio member of the board. (b) Each member shall serv:: without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-140. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 4. That Chapter 2, Division 9, Commission on Disability, Section 2-152 and Section 2-155, of the Code of the City is hereby amended to read as follows: Sec. 2-152. Membership; term. (a) The commission shall consist of eleven (11) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the commission, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-155. Minutes; annual report; work plan. The commission shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the commission shall file a report with the City Clerk setting forth the activities of the commission for the previous year. On or before November 30 of each year, the commission shall file a work plan with the City Clerk for the following year. Section 5. That Chapter 2, Division 10, Commission on the Status of Women, Section 2-167 and Section 2-170, of the Code of the City is hereby amended to read as follows: Sec. 2-167. Membership; term. (a) The commission shall consist of thirteen (13) members appointed by the City Council . In addition, the county may appoint a representative to serve as an ex-officio non-voting liaison to the commission. 2 (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the commission, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-170. Minutes; annual report; work plan. The commission shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the commission shall file a report with the City Clerk setting forth the activities of the commission for the previous year. On or before November 30 of each year, the commission shall file a work plan with the City Clerk for the following year. Section 6. That Chapter 2, Division 11, Community Development Block Grant Commission, Section 2-182 and Section 2-185, of the Code of the City is hereby amended to read as follows: Sec. 2-182. Membership; term. (a) The commission shall consist of thirteen (13) members appointed by the City Council , including persons of low and moderate income who are residents of slum and blight areas and/or are residents of the low- and moderate-income neighborhood strategy areas that have been identified by the city. (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the commission, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-185. Minutes; annual report; work plan. The commission shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before October 31 of each year, the commission shall file a report with the City Clerk setting forth the activities of the commission for the previous CDBG fiscal year. On or before August 31 of each year, the commission shall file a work plan with the City Clerk for the following CDBG fiscal year. Section 7. That Chapter 2, Division 12, Cultural Resources Board, Section 2-202 and Section 2-205, of the Code of the City is hereby amended to read as follows: 3 Sec. 2-202. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-205. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 8. That Chapter 2, Division 13, Downtown Development Authority, Section 2-217 and Section 2-220, of the Code of the City is hereby amended to read as follows: Sec. 2-217. Membership; term. (a) Members of the board of the authority shall be appointed by resolution of the City Council . The authority shall consist of nine (9) members, eight (8) of which are either residents, landowners or tenants within the boundaries of the authority, and one (1) of which is a City Councilmember. (b) Terms of office, appointments, removals and the filling of vacancies of authority board members shall be established and governed as set forth in Title 31, Article 25, Part 8, of the Colorado Revised Statutes, as amended. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-220. Minutes; annual report; work plan. The authority shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the authority shall file a report with the City Clerk setting forth the activities of the authority for the previous year. On or before November 30 of each year, the authority shall file a work plan with the City Clerk for the following year. Section 9. That Chapter 2, Division 14, Electric Board, Section 2-235, of the Code of the City is hereby amended to read as follows: 4 Sec. 2-235. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 10. That Chapter 2, Division 15, Golf Board, Section 2-237, Section 2-238 (1) and Section 2-240, of the Code of the City is hereby amended to read as follows: Sec. 2-237. Membership; term. (a) The board shall consist of nine (9) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-238. Functions. (1) To advise and make recommendations to the Cultural , Library and Recreational Services and the City Council for their approval as to rules, regulations, policies, administrative and budgetary matters pertaining to the operation and maintenance of all city-owned golf courses; Sec. 2-240. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 11 . That Chapter 2, Division 16, Housing Authority, Section 2-247 and Section 2-248, of the Code of the City is hereby amended to read a5 follows: Sec. 2-247. Membership; term. (a) The authority shall consist of five (5) commissioners appointed as set forth in Section 29-4-205, C.R.S. In addition to the appointment of such commissioners, the City Council may also appoint two (2) community representatives to the authority who 5 shall serve in an advisory capacity to the authority and who may make recommendations to the commissioners regarding the projects and activities of the authority. (b) Each commissioner shall serve without compensation for a term of five (5) years, and each community advisor shall serve without compensation for a term of (2) years. No commissioner or community advisor shall serve more than two (2) full , consecutive terms. Sec. 2-248. Minutes; annual report; work plan. The authority shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the authority shall file a report with the City Clerk setting forth the activities of the authority for the previous year. On or before November 30 of each year, the authority shall file a work plan with the City Clerk for the following year. Section 12. That Chapter 2, Division 18, Landmark Preservation Commission, Section 2-277 and Section 2-280, of the Code of the City is hereby amended to read as follows: Sec. 2-277. Membership; term. (a) The commission shall consist of seven (7) members appointed by the City Council . In making appointments to the commission, the City Council shall give due consideration to maintaining a balance of interests and skills in the composition of the commission and to the individual qualifications of the candidates including but not limited to their training, experience, knowledge or interest in any one (1) or more of the fields of architecture, landscape architecture, architectural history, structural engineering, general contracting, urban planning, mortgage lending and commerce. (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the commission, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-280. Minutes; annual report; work plan. The commission shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the commission shall file a report with the City Clerk setting forth the activities of the commission for the previous year. On or before November 30 of each year, the commission shall file a work plan with the City Clerk for the following year. 6 Section 13. That Chapter 2, Division 19, Library Board, Section 2-292 and Section 2-295, of the Code of the City is hereby amended to read as follows: Sec. 2-292. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-295. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 14. That Chapter 2, Division 22, Natural Resources Advisory Board, Section 2-307 and Section 2-310, of the Code of the City is hereby amended to read as follows: Sec. 2-307. Membership; term. (a) The board shall consist of nine (9) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. That Chapter 2, Division 23, Parks and Recreation Board, Section 2-337, Section 2-338 (1) and Section 2-340, of the Code of the City is hereby amended to read as follows: Sec. 2-337. Membership; term. (a) The board shall consist of nine (9) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each i-dividual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-338. Functions. (1) To advise and make recommendations to the Cultural , Library and Recreational Services and the City Council for their approval as to rules, regulations, policies, administrative and budgetary matters pertaining to the department excluding matters relating to the operation and maintenance of city-owned golf courses and cemeteries; Sec. 2-340. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 16. That Chapter 2, Division 25, Planning and Zoning Board, Section 2-352 and Section 2-355, of the Code of the City is hereby amended to read as follows: Sec. 2-352. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council 8 for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-355. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 17. That Chapter 2, Division 29, Senior Advisory Board, Section 2-397 and Section 2-400, of the Code of the City is hereby amended to read as follows: Sec. 2-397. Membership; term. (a) The board shall consist of eleven (11) members, nine (9) of whom shall be appointed by the City Council and two (2) of whom shall be appointed by the Senior Center Council of the City Parks and Recreation Department (the "Senior Center Council ") . (b) Each member appointed by the City Council shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . Each member appointed by the City Council shall be subject to removal by the City Council . If a vacancy occurs on the board by reason of the departure of a member appointed by the City Council , it shall be filled by the City Council for the remaining unexpired portion of the term. No member appointed by the City Council shall serve more than two (2) consecutive four-year terms. (c) Each member appointed by the Senior Center Council shall serve without compensation for a term of two (2) years, except that members may be appointed by the Senior Center Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . Each member appointed by the Senior Center Council shall be subject to removal by the Senior Center Council . If a vacancy occurs on the council by reason of the departure of a member appointed by the Senior Center Council , it shall be filled by the Senior Center Council for the remaining unexpired portion of the term. No member appointed by the Senior Center Council shall serve more than two (2) consecutive two- year terms. Sec. 2-400. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each 9 year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 18. That Chapter 2, Division 30, Storm Drainage Board, Section 2- 412 (a) and (b) and Section 2-415, of the Code of the City is hereby amended to read as follows: Sec. 2-412. Membership; term. (a) The board shall consist of nine (9) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-415. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 19. That Chapter 2, Division 31, Transportation Board, Section 2- 431, of the Code of the City is hereby amended to read as follows: Sec. 2-431. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 20. That Chapter 2, Division 32, Water Board, Section 2-437 and Section 2-440, of the Code of the City is hereby amended to read as follows: Sec. 2-437. Membership; term. (a) The board shall consist of eleven (11) members appointed by the City Council . 10 (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. (c) No member shall serve more than three (3) consecutive four-year terms. Sec. 2-440. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Cade. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 21. That Chapter 2, Division 33, Zoning Board of Appeals, Section 2-452 and Section 2-455, of the Code of the City is hereby amended to read as follows: Sec. 2-452. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council . (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 2-455. Minutes; annual report; work plan. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. On or before November 30 of each year, the board shall file a work plan with the City Clerk for the following year. Section 22. That Chapter 3, Sections 3-32 and 3-35, pertaining to the Liquor Licensing Authority, of the Code of the City is hereby amended to read as follows: 11 Sec. 3-32. Membership; term. (a) The authority shall consist of seven (7) members appointed by the City Council . No person holding a license for the sale of alcoholic beverages or fermented malt beverages shall serve as a member of the authority. (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the authority, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 3-35. Minutes; annual report. The authority shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the authority shall file a report with the City Clerk setting forth the number of applications for licenses acted upon, the number of licenses granted and the number of denied and any other actions taken by the authority during the past year. Section 23. That Chapter 7, Section 7-27, pertaining to the Board of Elections, of the Code of the City is hereby amended, with the existing subparagraph (b) relettered accordingly, to read as follows: Sec. 7-27. Membership; term; compensation. (a) The board shall consist of the City Clerk and two (2) registered electors appointed by the City Council . (b) Each member shall serve for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Section 24. That Chapter 16, pertaining to the Massage Licensing Authority, Sections 16-17, 16-18, 16-19 and 16-20 of the Code of the City, is hereby amended to read as follows: Sec. 16-17. Membership; term. (a) The authority shall consist of the members of the Liquor Licensing Authority as set forth in § 3-32. No person holding a massage therapy license shall serve as a member of the authority. 12 Sec. 16-18. Functions. (a) The authority shall grant or refuse licenses for the operation of massage establishments as defined in Section 12-48.5- 103(1) , C.R.S. , to conduct investigations as are provided by law and to suspend or revoke any such licenses for cause in the manner provided by law. (b) The authority shall have the power to promulgate rules and regulations concerning the procedures for hearings before it and the presentation of evidence at hearings. Sec. 16-19. Officers; bylaws. The authority shall elect annually from its membership a chairperson and such other officers as may be required. Bylaws may be adopted by the authority, which bylaws shall not be inconsistent with the Charter and the Code. A copy of the bylaws shall be filed with the City Clerk for the use of the City Council immediately after adoption by the authority and they may be subject to the approval of the City Council . Sec. 16-20. Minutes; annual report; The authority shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the authority shall file a report with the City Clerk setting forth the activities of the authority for the previous year. Section 25. That Chapter 21, Section 21-27 and Section 21-28, pertaining to the Personnel Board, of the Code of the City is hereby amended to read as follows: Sec. 21-27. Membership; term. (a) The board shall consist of five (5) members appointed by the City Council . No officer or employee of the city is eligible for appointment to this board. (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All members shall be subject to removal by the City Council . If a vacancy occurs on the board, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 21-28. Functions. The board shall have the following functions: 13 (1) To advise the City Manager on matters of personnel policies and problems; and (2) In accordance with applicable administrative policy, to hear appeals from any decision of a Service Director regarding employment actions if requested to do so by the affected employee and, upon completion of the appeal process, to forward findings and recommendations to the City Manager. Section 26. That Chapter 21 , Division 2, pertaining to the Personnel Board, Section 21-29, Officers, is hereby repealed and reenacted to read as follows: Sec. 21-29. Officers; bylaws. The board shall elect annually from its membership a chairperson and such other officers as may be required. Bylaws may be adopted by the board, which bylaws shall not be inconsistent with the Charter and the code. A copy of the bylaws shall be filed with the City Clerk for the use of the City Council immediately after adoption by the board and they may be subject to the approval of the City Council . Section 27. That the following Section, pertaining to the Personnel Board, be added to Chapter 21, Division 2: Sec. 21-30. Minutes; annual report. The board shall take and file minutes in accordance with the requirements of § 2-73 of the Code, except that a tape recording or other reliable method of preserving a complete record of the board's proceedings may be utilized by the board when hearing an appeal . On or before January 31 of each year, the board shall file a report with the City Clerk setting forth the activities of the board for the previous year. Section 28. That Article IV of Chapter 21, Police Officers' Pension Plans, is hereby repealed and reserved. Section 29. That Chapter 21 , Sections 21-86, 21-87 and 21-89, pertaining to the Retirement Committee, of the Code of the City is hereby amended to read as follows: Sec. 21-86. Creation. The retirement plan provides for administration by a Retirement Committee, hereinafter ,eferred to in this Article as the committee. Sec. 21-87. Membership; term. (a) The committee shall consist of five (5) members. The Director of Finance shall serve as a standing member of the 14 committee, and the remaining four (4) members shall be appointed by the City Council . Three (3) of the appointed members shall be employees who are members of the retirement plan. All appointed members of the retirement plan shall be taxpaying electors of the city. (b) Each member shall serve without compensation for a term of four (4) years, except that members may be appointed by the City Council for a shorter term in order to achieve overlapping tenure. Appointments shall specify the term of office of each individual . All appointed members shall be subject to removal by the City Council . If a vacancy occurs on the committee, it shall be filled by the City Council for the remaining unexpired portion of the term. No member shall serve more than two (2) consecutive four-year terms. Sec. 21-89. Minutes; annual report; work plan. The Director of Finance shall take and file minutes in accordance with the requirements of § 2-73 of the Code. On or before January 31 of each year, the committee shall file a report with the City Clerk setting forth the activities of the committee for the previous year. On or before November 30 of each year, the committee shall file a work plan with the City Clerk for the following year.
