AMENDING SECTIONS 2-34 AND 2-35 OF THE CODE
OF THE CITY OF FORT COLLINS RELATING
TO THE FIREMEN'S PENSION FUND

1. That follows
Section 2-34, Contribution from salaries ; refund of
contributions ; vesting clause.
A. The members of the Poudre Fire Authority who were
hired as members of the Fire Department of the City
of Fort Collins prior to April 8, 1978 shall
contribute monthly eight percent (8%) of their
respective monthly salaries into the Firemen ' s
Pension Fund of the City of Fort Collins . In order
to effect such contribution , the Director of
Finance is hereby authorized and directed to deduct
the appropriate amounts , as described in this
subsection , from the respective monthly salaries of
the members of the Poudre Fire Authority and to
deposit the same in the Firemen' s Pension Fund of
the City of Fort Collins .
B. Any member subject to the provisions of subsection
A, above, who leaves the service of the Poudre Fire
Authority prior to becoming eligible for a pension
for any reason, other than such member's death or
disability , shall receive, upon demand by such
member, a refund of all funds that shall have been
paid into such fund by that member, provided that
such demand be made in writing within one (1) year
of date of termination of employment . Such
refund shall not include accumulated interest on
the member's contributions or any portion of the
city's or Poudre Fire Authority' s contributions to
the Firemen' s Pension Fund.
C. If any member subject to the provisions of subsec-
tion A, above, who terminated his service with the
Poudre Fire Authority and received a refund of his
contributions to the Fund pursuant to subsection B,
above, subsequently reenters the service of the
Poudre Fire Authority as an active member, such
member shall thereafter be considered a member of
the plan established by part 10 of article 30 of
title 31, C.R.S. Credit for prior service, if any,
shall be obtained through negotiations between the
member and the State Fire and Police Pension
Association Board.
D. In lieu of having his contributions returned as
provided in subsection B, above, a member subject
to the provisions of subsection A, above, who
leaves the service of the Poudre Fire Authority
prior to becoming eligible for a pension for any
reason, other than such member's death or disabil -
ity, who has at least ten (10) years of credited
service may leave his contributions with the Fund,
provided that his intention to do so is made known
to the Board of the Firemen ' s Pension Fund in
writing within one (1) year of date of termination
of employment. When the inactive member reaches
age 55, he shall be eligible to receive an annual
vested benefit equal to two and one-half percent
(2.5e) of his salary at the time of termination of
employment multiplied by his years of active
service, not to exceed twenty (20) years . Said
pension will be paid to the inactive member on a
monthly basis. For the purposes of this subsec-
tion , "credited service" shall include service with
the Fire Department of the City of Fort Collins and
the Poudre Fire Authority but shall not include
service with any other fire department , fire
protection district or fire authority created by
intergovernmental agreement. If, at any time after
the inactive member becomes eligible to receive the
above described annual vested benefit, such member
accepts a salaried position in any capacity in a
fire department, fire protection district or fire
authority created by intergovernmental agreement,
in the state of Colorado , the payment of his
pension shall be suspended during the period he
holds such position.
E. If any member subject to the provisions of sub-
section A, above, who terminated his service with
the Poudre Fire Authority and elected to leave his
contributions with the Fund pursuant to subsection
D, above, subsequently reenters the service of the
Poudre Fire Authority as an active member, such
member shall be considered a member of the plan

established by part 10 of article 30 of title 31,
C.R .S . , for his service after reentry . Such
member shall receive no credit for prior service
but shall be entitled to the benefits described in
subsection D, above, in addition to the benefits
derived from membership in the plan established by
part 10 of article 30 of title 31, C.R.S.
Section 2. That Section 2-35 of the Code of the City of Fort Collins
be, and the same hereby is, repealed and reenacted as follows:
Section 2-35, Conformity to statutory provisions
The provisions of part 10 of article 30 of title 31,
C.R.S. , as may be amended from time to time, relating
to firemen's pensions shall apply to all members of the
Poudre Fire Authority hired on or after April 8,
1978 and all duties, rights , obligations and benefits
relating to firemen' s pensions for such members shall
be in accordance with said statutory provisions .
