OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE AND PRIOR YEAR RESERVES IN THE
TRANSPORTATION SERVICES FUND AND AUTHORIZING THE TRANSFER
OF APPROPRIATIONS FROM THE STREET OVERSIZING FUND TO THE
TRANSPORTATION SERVICES FUND FOR THE ANALYSIS AND DETERMINATION OF
APPROPRIATE INTERSECTION IMPROVEMENTS AND THE CONSTRUCTION
OF IMPROVEMENTS AT THE INTERSECTION OF
STATE HIGHWAY 14 AND LEMAY AVENUE
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the then current estimate of actual
and anticipated revenues to be received during the fiscal year; and
WHEREAS,Article V,Section 9,ofthe Charter,also permits the City Council to appropriate
by ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated; and
WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpended appropriated amount or portion thereof from one fund or capital project
to another fund or capital project, if the purpose for which the transferred funds are to be expended
remains unchanged; and
WHEREAS, the City of Fort Collins applied for federal Congestion Mitigation and Air
Quality(CMAQ)funds to be used for an Alternative Analysis of Intersection Improvements and the
construction of those improvements at the intersection of State Highway 14 and Lemay Avenue;and
WHEREAS, the aforementioned intersection is experiencing both delay and accident
problems which are expected to continue with the proposed Mulberry Lemay Crossing project; and
WHEREAS,the Colorado Department of Transportation(CDOT)has made available to the
City the sum of One Million Ninety Thousand Dollars ($1,090,000) in CMAQ funds to be used,
along with City matching funds, for an analysis of intersection improvements, and for the
construction of those improvements,at the intersection of State Highway 14 and Lemay Avenue(the
"Project'); and
WHEREAS, the estimated cost of the Project is One Million Three Hundred Seventy-Five
Thousand Seven Hundred Twenty-One Dollars ($1375,721); and
WHEREAS, staff has identified$1.375,721 from various sources to be appropriated for the
Project; and
WHEREAS,the City Council has adopted Resolution 99-117 authorizing the Mayor to enter
into an Intergovernmental Agreement between the City o f Fort Collins and the Colorado Department
of Transportation,which shall provide for the analysis and determination of appropriate intersection
improvements and the construction of those improvements at the intersection of State Highway 14
and Lemay Avenue at a cost not to exceed $1,375,721, to be funded from $1,090,000 in federal
Congestion Mitigation & Air Quality funds and local City matching funds totaling $285,721.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in
the Transportation Services Fund, the sum of ONE MILLION NINETY THOUSAND DOLLARS
($1,090,000),in federal Congestion Mitigation&Air Quality funds, upon receipt from the Colorado
Department of Transportation, to be used for the analysis and determination of appropriate
intersection improvements, and for the construction of those improvements, at the intersection of
State Highway 14 and Lemay Avenue, with any funds not expended for said project to be used for
other City projects which meet federal criteria for expenditure.
Section 2. That the unexpended appropriated amount of TWO HUNDRED FIVE
THOUSAND SEVEN HUNDRED TWENTY-ONE DOLLARS($205,721)is hereby authorized for
transfer from the Street Oversizing Fund to the Transportation Services Fund and appropriated
therein to be used for the analysis and determination of appropriate intersection improvements,and
for the construction of those improvements, at the intersection of State Highway 14 and Lemay
Avenue.
Section 3. That there is appropriated for expenditure from prior year reserves in the
Transportation Services Fund the sum of EIGHTY THOUSAND DOLLARS ($80,000) to be used
for the analysis and determination of appropriate intersection improvements,and for the construction
of those improvements, at the intersection of State Highway 14 and Lemay Avenue.
