OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CAPITAL PROJECTS FUND - BUILDING COMMUNITY CHOICES -
MASON TRANSPORTATION CORRIDOR PROJECT TO BE USED FOR DESIGN OF A
BICYCLE/PEDESTRIAN UNDERPASS
WHEREAS, on April 8, 1997, the voters of the City approved Ordinance No. 30, 1997,
authorizingthe imposition of a quarter cent sales and use tax f P q or the purpose of generating revenues

to construct certain transportation projects described in the Building Community Choices("BCC")
capital improvement program; and
WHEREAS, one such project approved for funding by the voters was the Mason
Transportation Corridor("MTC") project; and
WHEREAS, the MTC, envisioned as a transportation corridor that would enhance
opportunities for pedestrians, bicyclist, and transit riders, is a five-mile north-south byway within
the City, extending from Cherry Street on the north to approximately one-half mile south of
Harmony Road, and is centered along the Burlington Northern Santa Fe Railway tracks, a few
hundred feet west of College Avenue; and
WHEREAS, the Colorado Department of Transportation ("CDOT") has awarded the City
a funding contract,totaling$295,000,to be used to initiate the design phase for a bicycle/pedestrian
trail underpass for the MTC,under the Burlington Northern Santa Fe railroad tracks to connect the
University Mall/Whole Foods Shopping Center to the Natural Resources Research Center/Colorado
State University Teaching Hospital campus; and
WHEREAS,the aforementioned funding contract calls for CDOT to contribute$237,117 in
Congestion Mitigation and Air Quality("CMAQ") dollars while the City must provide a required
local match of$57,883; and
WHEREAS, the City's 2006-2007 budget includes an appropriation, totaling $250,000 in
2006, an estimated contribution from CDOT of$200,000 and a local City match of$50,000, to be
used for design of the MTC - Bicycle/Pedestrian Underpass; and
WHEREAS,additional appropriations,totaling$45,000,are necessary to fund the difference
between the estimated cost included in the 2006 Budget ($250,000) and the contract awarded by
CDOT($295,000); and
WHEREAS, staff recommends the additional appropriations be funded from the following
sources:
CDOT - CMAQ funds $ 37,117
General Fund - Prior Year Reserve Designated for
Transportation Capital 7,883
Total $ 45,000
WHEREAS, design work for the MTC - Bicycle/Pedestrian Underpass is scheduled to
be completed by mid-2007,with the right-of-way and construction phases to be completed by 2008;
and
WHEREAS, the total estimated cost of the underpass project is $1,350,000 with an
additional $1,000,000 included in the 2006-2007 Budget (Proposed 2007 appropriations); and
WHEREAS, the City Council adopted Resolution 2006-xxx, on February 21, 2006,
authorizing the City to enter into an intergovernmental agreement with CDOT for the receipt of
CMAQ funds to be used for the design of the MTC - Bicycle/Pedestrian Underpass; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the
"Charter")permits the City Council to make supplemental appropriations by ordinance at any time
during the fiscal year, provided that the total amount of such supplemental appropriations, in
combination with all previous appropriations for that fiscal year,does not exceed the current estimate
of actual and anticipated revenues to be received during the fiscal year; and
WHEREAS, Article V, Section 10, of the Charter authorizes the City Council to
appropriate by ordinance during the fiscal year such funds for expenditure as maybe available from
reserves accumulated in prior year, notwithstanding that such reserves were not previously
appropriated; and
WHEREAS,City staff has determined that the appropriation ofproceeds from the CDOT
CMAQ grant as described herein will not cause the total amount appropriated in the Capital Projects
Fund - Mason Transportation Corridor project to exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,it is the desire of the Council to appropriate the sum of$37,117 from CDOT
CMAQ funds and$7,883 from the General Fund Prior Year Reserve Designated for Transportation
Capital to be used for the design of the MTC - Bicycle/Pedestrian Underpass.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated
revenue in the Capital Projects Fund - Building Community Choices - Mason Transportation
Corridor capital project, the sum of THIRTY-SEVEN THOUSAND ONE HUNDRED
SEVENTEEN DOLLARS ($31,117) from Colorado Department of Transportation Congestion
Mitigation&Air Quality funds to be used for the design of the MTC-Bicycle/Pedestrian Underpass.
Section 2. That there is hereby appropriated from the General Fund Prior Year
Reserve Designated for Transportation Capital, the sum of SEVEN THOUSAND EIGHT
HUNDRED EIGHT-THREE DOLLARS ($7,883) for transfer to the Capital Projects Fund -
Building Community Choices - Mason Transportation Corridor capital project, and appropriated
therein, to be used for the design of the MTC - Bicycle/Pedestrian Underpass.
