OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND
FOR THE NATURAL RESOURCES CMAQ PROJECT AND AUTHORIZING THE
TRANSFER OF MATCHING FUNDS PREVIOUSLY APPROPRIATED IN THE
NATURAL RESOURCES OPERATING BUDGET TO THE GRANT PROJECT
WHEREAS, motor vehicles remain the number one source of air pollution in Fort Collins;
and
WHEREAS,the Air Quality Plan has as a goal the reduction of total motor vehicle emissions
of high priority pollutants by focusing on both technology and behavioral change; and
WHEREAS, the Colorado Air Quality Control Commission has decided to terminate the
motor vehicle emissions testing program in the North Front Range, including Fort Collins, in
December 2006; and
WHEREAS, the emissions testing program has helped to reduce tailpipe emissions and
ozone-forming pollutants; and
WHEREAS, the City of Fort Collins has been awarded Congestion Mitigation and Air
Quality ("CMAQ") grant funds from the Colorado Department of Transportation in the amount of
$39,645; and
WHEREAS,the CMAQ funds will be used to conduct a pilot project to identify and repair
high-polluting vehicles and to test a voluntary"Change-of-Ownership" emission testing program;
and
WHEREAS, the grant requires $9,910 of matching funds which have been included in the
2005 Natural Resources budget and are available for transfer to the pilot project; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter")
enables the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided the total amount of such supplemental appropriations, in combination with all
previous appropriations for the fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the CMAQ grant funds as
described herein will not cause the total amount appropriated in the General Fund to exceed the
current estimate of actual and anticipated revenues to be received in that fund during the fiscal year;
and
WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpected and unencumbered amount or portion thereof from one project to another
project, provided that the purpose for which the transferred funds are to be expended remains
unchanged.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from unanticipated grant revenue in the General
Fund the sum of THIRTY-NINE THOUSAND SIX HUNDRED FORTY-FIVE DOLLARS
($39,645) for expenditure in the General Fund for the Natural Resources CMAQ High-Emitter Pilot
Program.
Section 2. That the unexpended appropriated amount of NINE THOUSAND NINE
HUNDRED TEN DOLLARS ($9,910) is authorized for transfer from the Natural Resources
operating budget in the General Fund to the Natural Resources CMAQ High-Emitter Pilot Program
and appropriated therein.
