OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE DEDICATION OF A PARCEL OF LAND AND A PERMANENT
PUBLIC TRANSPORTATION EASEMENT TO THE CITY OF LOVELAND
ON JOINTLY OWNED CITY AND CITY OF LOVELAND PROPERTY AT
THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT
WHEREAS, the City of Fort Collins and the City of Loveland jointly own, in equal
share, the Fort Collins-Loveland Municipal Airport, Loveland, Larimer County, Colorado, as
seen on attached Exhibit "A", attached hereto and incorporated herein by this reference; and
WHEREAS, the City of Loveland wishes to construct a roundabout at the intersection of
Crossroads Boulevard and Rocky Mountain Avenue and, for that purpose, wishes to acquire the
City's fee interest in a portion of a jointly owned parcel of land consisting of.571 acres in size,
more specifically described on Exhibit `B", attached hereto and incorporated herein by this
reference; and
WHEREAS, the City of Loveland has also requested that the City of Fort Collins convey
to Loveland a Permanent Public Transportation Easement, ("Easement") for the roundabout .354
acres in size and more specifically described on Exhibit"C"; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is
authorized to sell, convey or otherwise dispose of an interest in real property owned by the City,
provided the Council first finds by ordinance that such sale or disposition is in the best interests
of the City; and
WHEREAS, it is in the City's interest to convey its fee interest in the land described
above to Loveland and to grant the Easement for the future benefit to the Fort Collins-Loveland
Municipal Airport, without requiring that the City of Loveland pay compensation to the City for
the Easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the above described conveyance of the described fee interest and
Easement is in the best interests of the City of Fort Collins.
Section 2. That the Mayor is hereby authorized to execute such documents of
conveyance as are necessary to convey the Easement to the City of Loveland upon the terms and
conditions described above, and subject to such other terms and conditions as the City Manager,
in consultation with the City Attorney, determines are in the best interest of the City.
Introduced, considered favorably on first reading and ordered published this 7th day of
June, A.D. 2005, and to be presented for final passage on the 5th da f July, A.D. 2005.

Range 68 West and the Northeast Quarter of Section 4, Township 5 North,Range 68
West of the 6 h Principal Meridian, County of Larimer, State of Colorado, being more
particularly described as follows:
Basis of Bearings: The East line of the Northeast Quarter of said Section 4,being
monumented at the Northeast Comer of Section 4 by a 2-1/2" aluminum cap in a range
box stamped"LS 14823" and at the East Quarter Corner by a 2-1/2"aluminum cap
stamped"LS 14823"with a line between assumed to bear South 01°20'51" West,with
all bearings herein relative thereto.
BEGINNING at the Northeast Corner of said Section 4,Thence North 89°29'40" West,
50.02 feet along the North line of said Section 4 to the existing Westerly Right-of-Way
of Rocky Mountain Avenue, (County Rd 7) as described on the plat of Barnstorm Second
