HomeMy WebLinkAbout186 - 12/07/2004 - AUTHORIZING THE GRANTING OF A NON-EXCLUSIVE UTILITY EASEMENT TO THE CITY OF LOVELAND ON JOINTLY OWNE ORDINANCE NO. 186, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE GRANTING OF A NON-EXCLUSIVE UTILITY EASEMENT TO THE CITY OF LOVELAND ON JOINTLY OWNED PROPERTY AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT WHEREAS, the City of Fort Collins and the City of Loveland jointly own, in equal shares, the Fort Collins-Loveland Municipal Airport, Loveland, Latimer County, Colorado, as seen on attached Exhibit "A" ("the Airport"); and WHEREAS, the City of Loveland's Power Operations Division wishes to install a 200- amp electrical tie across a portion of the Airport property; and WHEREAS, the City of Loveland's Power Operations Division wishes to acquire a non- exclusive easement, as identified on attached Exhibit "B" (the "Easement Area"), over, on, across, and under the Airport's property to construct, operate, maintain, repair, remove, relocate and replace utility systems, including the perpetual right to enter upon said property for such purposes; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of an interest in real property owned by the City, provided the Council first finds by ordinance that such sale or disposition is in the best interests of the City; and WHEREAS, it is in the City's interest to grant said easement for future benefit to the Airport. Such easement will provide power to areas not presently serviced, facilitating Airport expansion. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above described conveyance of a non-exclusive utility easement under and across the Easement Area is in the best interests of the City of Fort Collins. Section 2. That the Mayor is hereby authorized to execute such documents of conveyance as are necessary to convey the Easement to the City of Loveland upon the terms and conditions described above, and subject to such other terms and conditions as the City Manager, in consultation with the City Attorney, determines are in the best interest of the City.
