OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND
WHEREAS,on July 28 and 29, 1997, certain areas of the City were severely damaged and
five lives were lost due to the flooding of Spring Creek; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the
Council to appropriate reserves accumulated in prior years at any time during the year; and
WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins also permits the
Council to appropriate unanticipated revenue received at any time during the year and to transfer
unexpended, appropriated amounts from one fund to another; and
WHEREAS,the flood destroyed or severely damaged numerous mobile homes and vehicles
located in the Johnson Center Mobile Home Park and the South College Trailer Park; severely
damaged public and private infrastructure; caused the evacuation of residences and businesses;
caused the temporary closure of businesses; and caused the loss or destruction of various items of
personal property; and
WHEREAS, the City wishes to provide payment for timely and efficient repair and
maintenance of public facilities and provide funding for flood incident services, and
WHEREAS, funds are available from General Fund prior year reserves, Transportation
Services prior year reserves, and appropriated amounts in the general fund for repair and
maintenance of public facilities and flood incident services; and
WHEREAS, Article II, Section 6, of the City Charter allows the City Council to pass an
emergency ordinance on first reading upon the affirmative vote of at least five members of the City
Council.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from prior year emergency reserves in the
General Fund the sum of TWO MILLION FIVE HUNDRED THOUSAND DOLLARS($2,500,000)
for repair and maintenance of public facilities and flood incident services.
Section 2. That the immediate adoption of this Ordinance is necessary to preserve,protect,
and advance the general welfare of the residents of the City of Fort Collins and the Council hereby
determines that an emergency exists to provide relief to flood victims and to repair public
infrastructure damaged by the flood, which needs severely affect the health, safety, and welfare of
all citizens.

Section 3. That the circumstances described above require the immediate passage of this
Ordinance, and this Ordinance is therefore enacted pursuant to Article II, Section 6, of the Charter
of the City of Fort Collins as an emergency Ordinance and shall be effective upon its passage.
Introduced, considered favorably by five (5) members of the Council of the City of Fort
Collins and finally passed as an Emergency Ordinance and ordered published this 5th day of
August, A.D. 1997. _
