OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 38 OF THE CODE OF THE CITY OF
FORT COLLINS BY ADOPTING THE COLORADO MODEL
ENERGY EFFICIENCY CONSTRUCTION AND RENOVATION
STANDARDS FOR NON-RESIDENTIAL BUILDINGS,
SEPTEMBER 1980, 3RD EDITION, WITH AMENDMENTS THERETO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter
38 of the Code of the City of Fort Collins be amended to include the
following:
Section 1 . Adoption of Standards.
Pursuant to the power and authority conferred upon the City Council of
the City of Fort Collins, Colorado, by Part 2 of Article XVI of Title 31,
C.R.S. , and Article II, Section 7, of the Charter of the City of Fort
Collins, there is hereby adopted as the Non-Residential Energy Conservation'
Standards of the City of Fort Collins, by reference thereto, the Colorado '
Model Energy Efficiency Construction and Renovation Standards for Non-
Residential Buildings, September 1980, 3rd Edition, pages eleven (11)
through sixty-two (62) , inclusive, published by the Colorado Office of
Energy Conservation, Building Standards Program, 1600 Downing Street, 2nd
Floor, Denver, Colorado, 80218, to have the same force and effect as if set
forth herein in every particular, except as specifically amended by the
provisions of this Chapter.
Section 2. Amendments and deletions to code.
The Colorado Model Energy Efficiency Construction and Renovation
Standards for Non-Residential Buildings, September 1980, 3rd Edition hereby
adopted is hereby amended and changed in the following respects:
A. Section 103.1 is amended to read as follows:
Section 103.1 Exempt Buildings
The following buildings are hereby exempt from complying
with this Chapter:
a. Buildings and structures or portions thereof whose
peak design rate of energy usage is less than 3.4 BTU/h per
square foot, or 1.0 watt per square foot of floor area for
all purposes.
b. Buildings and structures or portions thereof which
are neither heated nor cooled by systems which derive their
energy from depletable sources.
c. Buildings or portions of buildings used primarily
for the storage of materials and are uninhabited, except
for the handling of those materials, and are not heated
to 50OF or higher.
d. Historic buildings which are deliberately preserved
beyond their normal term of use because of historic associ-
ations, architectural interest, or public policy.
e. Buildings which are not air-conditioned by refriger-
ation and which are associated with heat producing indus-
tries, processes and operations, provided the basic building
heat is derived from these heat generating processes and the
supplemental energy expended for heating does not exceed 3.4
BTU/h per square foot of floor area, or the supplemental
energy provided for heating is not intended for use except
to protect the equipment or processes during down time. In
which event, the supplemental energy required for heating
shall not exceed that required if the building had a comply-
ing envelope.
B. Section 103.3 is amended to read as follows:
Section 103.3 Change of Occupancy
Any change of occupancy or use of any building or
structure, as specified in the Uniform Building Code, which
would require an increase in demand for either fossil fuel
or electrical energy supply, shall not be permitted unless
such building or structure is made to comply with the
requirements of this Chapter.
C . Section 105.0 is amended to read as follows:
Section 105.0 Plans and Specifications
With each application for a building permit for such
construction regulated herein, a statement of design
compliance with this Chapter shall be provided. Such
statement of compliance shall be prepared by a professional
licensed in this state to perform the necessary design
review. Accompanying the statement of compliance, plans and
specifications shall be submitted in sufficient detail to
substantiate compliance with this Chapter.

Section 3. Copies of code on file; sale.
At least three (3) copies of the Colorado Model Energy Efficiency
Construction and Renovation Standards for Non-Residential Buildings ,
September 1980, 3rd Edition, shall be on file in the office of the City
Clerk of the City of Fort Collins, Colorado, at least fifteen (15) days
preceding the date set for hearing and may be inspected by any interested
persons during normal business hours. After the public hearing thereon and
final reading and adoption by reference, the Colorado Model Energy Effi-
ciency Construction and Renovation Standards for Non-Residential Buildings
as finally adopted shall be available for sale to the public through the
office of the City Clerk at a price not to exceed the city' s actual costs.
Introduced, considered favorably on first reading, and ordered pub-
