OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 3 OF THE CODE OF THE CITY
OF FORT COLLINS RELATING TO ALCOHOLIC BEVERAGES
WHEREAS, the City Liquor Licensing Authority has reviewed its process for granting
written consent to liquor licensees seeking to change, modify or alter their own liquor-licensed
premises; and
WHEREAS,the requirement that such written consent be obtained by liquor licensees is set
forth in state regulation relating to beer and liquor licenses, along with certain related standards and
procedural requirements; and
WHEREAS, the Liquor Licensing Authority has determined that clarification and
simplification of the process for considering and acting upon requests for such written consent in the
City Code would be beneficial for the Authority and for licensees; and
WHEREAS, the Liquor Licensing Authority further has proposed revision of the Code for
greater consistency with applicable state regulations regarding modification of licensed premises;
and
WHEREAS, the Liquor Licensing Authority considered the proposed City Code revisions
set forth herein, and recommended at its regular meeting on April 24, 1996, that the City Council
adopt such Code revisions.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 3-74(a) of the Code of the City of Fort Collins be amended to read
as follows:
Sec. 3-74. Application fees.
(a) Application fees shall be payable to the city as follows:
Fees
(1) New license (including change
of class of license) $450.
(2) Transfer of ownership or
change of location of license 250.
(3) Temporary license (in case of
inadvertent failure to renew license) 250.
(4) Temporary permit(to allow
continued operation during
period that an application for
transfer of ownership is pending) 100.
(5) Renewal of license 50.
(6) Manager registration 75.
(7) Special events permit(per day) 25.
(8) Modification of premises 75.
(9) Change in corporate structure,
per each required background
investigation 50.
Not to exceed a total of 250.
(b) The foregoing fees shall be nonrefundable. The foregoing fees shall be
in addition to any fees imposed by the state.
Section 2. That Section 3-78 of the Code of the City of Fort Collins shall be amended to
read as follows:
Sec. 3-78. Modification of premises.
(a) No licensee shall physically change, alter or modify the licensed premises
from that shown in the plans and specifications submitted at the time the licensee
obtained the original license until written approval to do so has been received from
the authority and the state licensing authority, pursuant to Regulation 47-106.2, as
adopted by the state.
(b) Requests for changes,alterations or modifications of the licensed premises
shall be on such forms as are provided by the state licensing authority and, in
addition, on such forms as may be provided by the city, if any. The request shall be
accompanied by plans and specifications, on pages not larger than eight and one-half
(8'/2) inches by eleven (11) inches, which shall be sufficient to advise the authority
of the scope and nature of the proposed request.
