OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING FEDERAL GRANT REVENUE AND
AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN PROJECTS
IN THE TRANSPORTATION SERVICES FUND FOR THE OPERATION
OF THE NORTH FRONT RANGE TRANSPORTATION & AIR
QUALITY PLANNING COUNCIL'S 2001-2002 METROPOLITAN PLANNING
ORGANIZATION ADMINISTRATION PROGRAM YEAR
WHEREAS, the North Front Range Transportation & Air Quality Planning Council (the
"NFRT & AQPC") is the Metropolitan Planning Organization (MPO) and lead air quality
planning agency for the North Front Range region; and
WHEREAS, voting members of the MPO include Fort Collins, Greeley, Loveland,
Evans, Timnath, Windsor, Berthoud, LaSalle, Johnstown, Garden City, Larimer County, Weld
County, the State of Colorado Transportation Commission, and the State of Colorado Air
Quality Control Commission; and
WHEREAS, the funds for the administration of the MPO program are federal
transportation program funds appropriated by the federal government and administered by the
Colorado Department of Transportation (CDOT), based on the federal fiscal year of October 1
through September 30; and
WHEREAS, under the terms of an Intergovernmental Agreement, dated May 17, 2001,
between the City and the MPO, entitled Intergovernmental Agreement for the Provision of
Support Services, the City provides the support services to the MPO, including accounting and
financial services, purchasing services, risk management services, budgeting services, human
resource services, and legal services, and accordingly, manages federal grant revenue and
matching funds received on behalf of the MPO; and
WHEREAS, on behalf of the MPO, the City will receive in MPO program year 2001-
2002, federal grant revenue from various federal transportation programs totaling $525,179
which, along with required matching funds from MPO member entities totaling $115,283, will
be used to provide coordinated, comprehensive and cooperative transportation and air quality
planning services in the North Front Range region; and
WHEREAS, the City of Fort Collins' share for supporting the 2001-2002 MPO program,
totaling $46,476, is included in the City's 2002-2003 Biennial Budget; and
WHEREAS, Article V, Section 11, of the Charter of the City of Fort Collins (the
"Charter") provides that appropriations for a federal grant shall not lapse if unexpended at the
end of the fiscal year until the expiration of the federal grant; and
WHEREAS, CDOT will permit unexpended funds remaining in the 2000-2001 MPO
program in the amount of$140,639 to be reallocated and used for the 2001-2002 MPO year; and
WHEREAS, Article V, Section 9, of the Charter permits the City Council to make
supplemental appropriations by ordinance at any time during the fiscal year, provided that the
total amount of such supplemental appropriations, in combination with all previous
appropriations for that fiscal year, does not exceed the then current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, Article V, Section 10, of the Charter authorized the City Council to transfer
by ordinance any unexpended and unencumbered amount or portion thereof from one fund or
capital project to another fund or capital project provided that the purpose for which the funds
were initially appropriated remains unchanged; and
WHEREAS, City Staff has determined that the appropriation of federal grant revenue
administered through CDOT and unanticipated local matching shares from MPO member
entities will not cause total appropriations to exceed the current estimate of actual and
anticipated revenues to be received during any fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from federal grant revenue
in the Transportation Services Fund, 2001-2002 Metropolitan Planning Organization program,
the sum of FIVE HUNDRED TWENTY FIVE THOUSAND ONE HUNDRED SEVENTY-
NINE DOLLARS ($525,179) upon receipt from federal fiscal year 2001-2002 funds
administered through the CDOT, to be used for the 2001-2002 MPO program year.
Section 2. That there is hereby appropriated from federal grant program revenue in the
Transportation Services Fund, 2001-2002 MPO program, the sum of ONE HUNDRED
FIFTEEN THOUSAND TWO HUNDRED EIGHTY THREE DOLLARS ($115,283), upon
receipt from MPO member entities local shares, to be used for the 2001-2002 MPO program
year.
Section 3. That the unexpended and unencumbered amount of ONE HUNDRED
FORTY THOUSAND SIX HUNDRED THIRTY NINE DOLLARS ($140,639) is hereby
authorized for transfer from the 2000-2001 MPO grant program to the 2001-2002 MPO grant
program, upon the effective date of this Ordinance.
