OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE
IN THE CAPITAL PROJECTS FUND -TRAFFIC SIGNAL TIMING SYSTEM PROJECT
TO BE USED FOR THE INSTALLATION OF FIBER OPTIC AND WIRELESS
COMMUNICATIONS AND THE PURCHASE OF ADDITIONAL EQUIPMENT
FOR THE ADVANCED TRAFFIC MANAGEMENT SYSTEM
WHEREAS, the City is in the process of replacing its traffic signal system with a
modernized Advanced Traffic Management System("ATMS"); and
WHEREAS, to date, City Council has approved appropriations totaling $5,405,646,
towards the replacement ATMS; and
WHEREAS, the Colorado Department of Transportation ("CDOT") has awarded the City
a federal Congestion Mitigation and Air Quality ("CMAQ") grant, in the amount of $893,849,
for additional fiber optic and wireless communications and the purchase of additional traffic
management equipment; and
WHEREAS, the federal portion of the aforementioned grant, to be reimbursed to the City
by CDOT is $827,899; and
WHEREAS, the City's required local match is $65,950, and is available as follows:
Capital Projects Fund -Traffic Operations Facility
Project-Existing Appropriations $ 12,950
Capital Projects Fund- Traffic Signal Timing System
Project-Existing Appropriations 53,000
Total $ 65,950
WHEREAS, the City Council adopted Resolution 2004-030, on March 16, 2004,
authorizing the Mayor to enter into an intergovernmental agreement with the CDOT for the
receipt of federal CMAQ grant funds to be used for additional fiber optic and wireless
communications and additional traffic management equipment; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the
City Council to make supplemental appropriations by ordinance at any time during the fiscal
year, provided that the total amount of such supplemental appropriations, in combination with all
previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the federal CMAQ grant
as described herein will not cause the total amount appropriated in the Capital Projects Fund -
Traffic Signal Timing System Project to exceed the current estimate of actual and anticipated
revenues to be received during any fiscal year; and
WHEREAS, Article V, Section 10 of the Charter of the City authorizes the City Council
to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one
fund or capital project to another fund or capital project, provided that the purpose for which the
funds were initially appropriated no longer exists; and
WHEREAS, it is the desire of the Council to appropriate the sum of$827,899 in federal
CMAQ grant funds in the Capital Projects Fund - Traffic Signal Timing System project, and
authorize the transfer of existing appropriations totaling $12,950 from the Capital Projects Fund
- Traffic Operations Facility project to the Capital Projects Fund - Traffic Signal Timing System
project to be used with existing appropriations of$53,000, for additional fiber optic and wireless
communications, and additional traffic management equipment subject to City Council adopting
Resolution 2004-030.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Capital Projects Fund - Traffic Signal Timing System project the sum of EIGHT
HUNDRED TWENTY-SEVEN THOUSAND EIGHT HUNDRED NINETY-NINE DOLLARS
($827,899), upon receipt from the Colorado Department of Transportation federal Congestion
Mitigation and Air Quality grant funds, to be used for additional fiber optic and wireless
communications and additional traffic management equipment.
Section 2. That the unexpended appropriated amount of TWELVE THOUSAND NINE
HUNDRED FIFTY DOLLARS ($12,950) is hereby authorized for transfer from the Capital
Projects Fund - Traffic Operations Facility project to the Capital Projects Fund - Traffic Signal
Timing System to be used for additional fiber optic and wireless communications and additional
traffic management equipment.

of March, A.D. 2004, and to be presented for final passage on the 6th day of April, A.D. 2004.
