OF THE COUNCIL OF THE CITY OF FORT COLLINS, COLORADO
AMENDING ARTICLES IX AND X OF CHAPTER 2
OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO
FIREMEN'S AND POLICEMEN'S PENSION FUNDS
WHEREAS, the City previously established pension plans for certain
employees who are employed by the City's Police Department and the Poudre
Fire Authority; and
WHEREAS, the City has now amended the previous plans by separate
restatements of the plans in their entirety; and
WHEREAS, certain provisions of Articles IX and X of Chapter 2 of the
Code of the City of Fort Collins are replaced by the provisions of the new
plans.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following amendments are made to Articles IX and X of
Chapter 2 of the Code of the City of Fort Collins:
Section 1. The title of Article IX is hereby amended to "Firefighters'
Pensionion— Fund.
Section 2. Section 2-26 of the Code is repealed and readopted as
follows:
§2-26. Adoption of pension plan.
The maintenance of the Firefighters' Pension Fund of the City of Fort
Collins and all duties, rights, obligations and benefits relating to
firefighters ' pensions for individuals hired before April 8, 1978 shall be
in accordance with the terns and conditions of the City of Fort Collins
Firefighters ' Pension Plan as adopted by City Council by resolution on
January 21, 1986, and as amended from time to time.
Section 3. Section 2-27 of the Code is repealed and readopted as
follows:
§2-27. False statements.
Any person who knowingly makes any false statements or falsifies or
permits to be falsified any record of the City, the Poudre Fire Authority
or the Firefighters ' Pension Fund, in an attempt to defraud the
Firefighters ' Pension Fund, shall be guilty of a violation of this section.
No conviction or penalty resulting therefrom shall excuse such person from
the duty to make full restitution to the fund, and such duty may be
enforced by action at law or otherwise in any court of
competent jurisdiction.
Section 4. The following sections of the Code are hereby repealed in
thei F entirety: Section 2-28, Section 2-29, Section 2-30, Section 2-31,
Section 2-32, Section 2-33 and Section 2-34.
Section 5. The title of Article X is hereby amended to "Police
Officers Pension Fund".
Section 6. Section 2-36 of the Code is repealed and readopted as
follows:
§2-36. Adoption of pension plan.
The maintenance of the Police Officers ' Pension Fund of the City of
Fort Collins and all duties, rights, obligations and benefits relating to
police officers ' pensions for individuals hired before April 8, 1978 shall
be in accordance with the terms and conditions of the City of Fort Collins
Police Officers ' Pension Plan as adopted by City Council by resolution on
January 21, 1986, and as amended from time to time.
Section 7. The following sections of the Code are hereby repealed in
their entirety: Section 2-37, Section 2-38, Section 2-39, Section 2-40,
Section 2-41, Section 2-42, Section 2-43, Section 2-43.1, Section 2-43.2,
Section 2-43.3, Section 2-43.4, Section 2-43.5, Section 2-43.6, Section
2-43.8, Section 2-43.9 and Section 2-43.10.
Section 8. Section 2-43.7 is repealed and readopted as follows:
§2-43.7. False statements.

Pension Fund, in an attempt to defraud the Police Officers ' Pension Fund,
shall be guilty of a violation of this section. No conviction or penalty
