OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF 425 1OTH STREET,
FORT COLLINS, COLORADO
TO POUDRE LANDMARKS FOUNDATION
WHEREAS, concurrent with this Ordinance, the Council has considered and adopted
Ordinance No. 080, 2002, authorizing the acceptance of the donation of 425 loth Street, in Fort
Collins (the "Romero House"), and appropriating that donation; and
WHEREAS, the Romero House was designated as a local landmark in August 2001, in
the Andersonville neighborhood of Fort Collins; and
. WHEREAS, City staff, working with a citizen group known as' Amigos de la Casa
Romero/Friends of the Romero House (the "Amigos"), and the Poudre Landmarks Foundation
(the "Foundation"), have developed a general plan pursuant to which the Romero House would
be developed into the only museum in the North Front Range dedicated to recognizing and
remembering the contributions of Hispanics, Latinos, and Mexicans in Northern Colorado
(collectively"Hispanic Coloradans"); and
WHEREAS, the Foundation has agreed to lease the Romero House from the City upon
completion of the donation, and to work with the Amigos to raise funds and carry out the
development of the above-described museum, and then to manage and operate it as a living
history museum available to the public, as well as using the Romero House as a neighborhood
resource center and site for cultural events that represent the culture and history of Hispanic
Coloradans; and
WHEREAS, City staff has worked with the Foundation to negotiate a proposed fifteen-
year lease agreement providing for the Foundation to proceed with and carry out the
development and operation of the Romero House as described herein, at a nominal lease rate of
one dollar per year, a copy of which lease agreement is on file in the Office of the City Clerk and
available for public inspection (the "Lease Agreement"); and
WHEREAS, the City has worked successfully with the Foundation on the historic
restoration and renovation of both the Avery House and City Water Works Building projects,
and currently leases those properties to the Foundation under terms generally consistent with
those in the Lease Agreement; and
WHEREAS, the proposed lease to the Foundation of the Romero House as provided
hereunder would advance the preservation of an historic resource of significance to Fort Collins,
would safeguard this remnant of the City's historical past against vandalism, neglect, and
inappropriate redevelopment, and would enhance the quality of life in Fort Collins by the
preservation of this historic resource and the inclusion of heritage of Hispanic Coloradans in the
daily life and development of the City and the community; and
WHEREAS, because of the public policy objectives to be served through the lease of the
Romero House and the responsibilities assigned to and accepted by the Foundation in the Lease
Agreement for developing and operating the Romero House as described herein, City staff has
recommended that nominal rent in the amount of one dollar per year is an appropriate and
reasonable compensation amount for the Romero House, as set forth in the Lease Agreement;
and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to lease any and all interests in real property owned in the name of the City, provided
that Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the lease by the City of 425 10th Street to the Foundation, pursuant to the
terms and conditions set forth herein and in the Lease Agreement, is in the best interests of the
City of Fort Collins.
Section 2. That the Mayor is hereby authorized to enter into the Lease Agreement
leasing 425 loth Street in Fort Collins to the Foundation for an original term of fifteen years, at a
lease rate of ONE DOLLAR ($1.00) per year, together with such other related provisions
determined necessary to protect the interest of the City by the City Manager, in consultation with
the City Attorney.
