OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES FROM THE STORM DRAINAGE FUND FOR
IMPROVEMENTS TO THE DRY CREEK DRAINAGE BASIN CAPITAL PROJECT
WHEREAS, storm drainage fees are collected in the Dry Creek Basin to fund the
construction of master plan basin improvements as well as minor capital improvements; and
WHEREAS,the Council has included the installation of the Dry Creek Channel from the Fort
Collins Downtown Airport to the Poudre River as a capital improvement in the Dry Creek Basin;
and
WHEREAS, due to the construction of the Timberline Road extension, the City wishes to
construct the aforementioned project ahead of schedule in order to realize savings due to joint project
construction, and to minimize impacts to the public; and
WHEREAS, Article V, Section 4 of the Charter of the City of Fort Collins (the "Charter")
requires that capital projects be itemized in the budget by individual project; and
WHEREAS,the result of such itemization is that each individual capital project in the budget
is treated as a separate fund; and
WHEREAS, storm drainage basins are treated as individual capital projects; and
WHEREAS, Article V, Section 9 of the Charter permits the City Council to appropriate by
ordinance at any time during the fiscal year such funds as may be available from reserves
accumulated in prior years,notwithstanding that such reserves were not previously appropriated; and
WHEREAS, funds to cover these expenditures are available from prior year reserves in the
Storm Drainage fund.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated from prior year reserves in the Storm Drainage fund the
sum of ONE MILLION TWO HUNDRED THOUSAND DOLLARS($1,200,000)for the Dry Creek
Basin capital project be used to construct the Dry Creek Channel from the Fort Collins Downtown
Airport to the Poudre River.
