OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 29 OF THE CODE OF THE CITY OF FORT COLLINS
SO AS TO ADD A NEW ARTICLE PERTAINING TO ADMINISTRATIVE FEES
WHEREAS, the City, as a Colorado home rule municipality, has various mechanisms
available to it for generating revenue for the purpose of deriving funds to carry out the City's public
functions; and
WHEREAS, those mechanisms include the establishment of various kinds of fees to defray
the cost of providing certain administrative services and making available for public use certain
public facilities; and
WHEREAS,historically,the City Council has reviewed and approved, as part of the City's
budget process, the amounts of various administrative fees, such as fees and charges for recreation
and cultural services, cemeteries, and others; and
WHEREAS,the City Manager and the City's Budget Director have recommended that the
amounts of such administrative fees hereafter be established by the City Manager, according to
certain criteria established by the City Council by ordinance; and
WHEREAS,on June 17, 1997,the City Council adopted Resolution 97-87 approving certain
amendments to the City's Financial Management Policies, including an amendment to the City's fee
policy; and
WHEREAS, said amendment provides that all fees imposed by the City will be established
by the City Council by ordinance and that the amounts of certain kinds of special service fees, such
as user fees charged for the use of the City's recreation and cultural facilities,may be determined by
the City Manager, according to criteria established by the City Council by ordinance, absent any
provision of the City Charter or Code to the contrary; and
WHEREAS, the City Council believes that such a change in administrative policy would be
appropriate and desirable in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that the title of Chapter 29 of the City Code is hereby amended so as to read "Fees" and
that such Chapter is further amended by the addition of the following Article I, with the existing
provisions of Chapter 29 to be hereafter identified as Article II of said Chapter:
ARTICLE 1. ADMINISTRATIVE FEES.
Sec. 29-1. Establishment of administrative fees.
In order to defray the cost of providing certain administrative services, as well as
the cost of making available for public use certain city facilities, the City Manager
may establish fees to be paid by the users of such services and facilities. Such fees
may include, without limitation, fees for recreation and cultural services, cemeteries
and the use of other city facilities. The City Manager shall include in his or her
recommended budget an itemization of the fees currently being charged for such
services and facilities, together with an estimate of the amount of annual revenue
anticipated to be generated by such fees during the budget term.
Sec. 29-2. Amounts of administrative fees.
The amounts of the fees established under the authority of § 29-1 shall be
determined by the City Manager according to the following criteria:
(1) The amount of estimated revenue to be generated by each such fee shall not
exceed the estimated cost of providing the service or facility for which such
fee is charged;
(2) Any distinctions made among feepayers, in terms of the amounts to be paid
by such feepayers for the use of a particular service or facility, shall be
reasonably related to a legitimate municipal purpose. Such distinctions may
include, without limitation, reduced rates for senior citizens, youth, lower
income residents and disabled persons;
(3) In determining the extent to which the total cost of a particular service or
facility should be recovered through the imposition of fees,the City Manager
may consider, without limitation:
(a) the nature of the facilities or services;
(b) the nature and extent of the benefit to the feepayers;
(c) the level of demand for a particular service or facility; and
(d) ease of collection.
