OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND
FOR TRANSFER TO THE CAPITAL PROJECTS FUND
WHEREAS, Article V, Section 8, of the Charter of the City of Fort
Collins authorizes the City Council to provide by ordinance for payment of
any expense from prior year reserves at any time such reserves are
available; and
WHEREAS, Article V, Section 15, of the Charter of the City of Fort
Collins authorizes the City Council to transfer unexpended, appropriated
amounts from one fund to another; and
WHEREAS, funds were contributed by the Arbor Commercial Plaza
developer as a mitigation payment for impacts upon the environment and
wildlife habitat; and
WHEREAS, these funds are available in General Fund prior year
reserves.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That there is hereby appropriated for expenditure from
prior year reserves in the General Fund the sum of TWENTY-FIVE THOUSAND
DOLLARS ($25,000) for transfer to the Capital Projects Fund.
Section 2. That TWENTY-FIVE THOUSAND DOLLARS ($25,000) is hereby
transferred from the Capital Projects Fund, and appropriated for
expenditure in the Capital Projects Fund for purposes of Wildlife Habitat
Mitigation as follows, to wit:
1 . Purchase of lands which have been identified as areas of high
sensitivity with respect to potential as wildlife habitat.
2. Purchase of conservation easements for land areas which have been
identified as areas of high sensitivity with respect to potential for
wildlife habitat.
3. Enhancement of wildlife habitat in areas identified as of high or
moderate sensitivity, through grading , planting , vegetation
modification, or other appropriate restoration techniques.
4. Enhancement of wildlife habitat in existing parks, open spaces,
stormwater management areas, or streetscapes.
5. Funding assistance for development or enhancement of wildlife habitat,
or educational/interpretation opportunities in City owned Natural areas
(e.g. the Gustav Swanson Nature Area), where such projects are of
benefit to the community at large, and involve public, private, or
non-profit funding sources.
