OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 2-247 OF THE CITY CODE PERTAINING
TO THE COMPOSITION OF THE BOARD OF COMMISSIONERS OF THE
FORT COLLINS HOUSING AUTHORITY
WHEREAS, Section 2-247 of the City Code presently provides that the Housing Authority
shall consist of commissioners selected by the City Council in the manner provided by state statute;
and
WHEREAS, the manner of selection specified in Section 2-247 permits the Council to
appoint its own members to serve ex-officio as the commissioners of the Authority or, in the
alternative,to appoint five commissioners, one of whom may be a City official; and
WHEREAS, the state statutes have recently been amended to allow for the appointment of
up to nine commissioners if the second alternative method of appointment is chosen by the Council;
and
WHEREAS,because ofthe increasing complexity ofthe operations ofthe Housing Authority
and the need for diversity and different areas of expertise on the Board of Commissioners, the
Council believes it to be in the best interests of the City to increase the number of commissioners
from five to seven; and
WHEREAS, Section 2-247(b)of the City Code also presently provides for the appointment
of two community representatives in addition to the commissioners; and
WHEREAS, the City Council believes that the expansion of the Board of Commissioners
from five to seven members will alleviate the need for the appointment of community
representatives, especially in view of the fact that federal law currently requires that one of the
members of the Board of Commissioners must be a tenant of the Housing Authority; and
WHEREAS, the Council has previously appointed a committee of its members (the
"Reorganization Committee") to identify candidates for appointment to a new Board of
Commissioners and to make recommendations to the Council about alternatives available to the
Housing Authority for continuing its operations in the most efficient and cost-effective manner,
including any recommended changes to the organizational structure of the Authority; and
WHEREAS, the foregoing changes are consistent with the recommendations of the
Reorganization Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 2-247 of the City Code shall be, and the same hereby is, amended so as to
read in its entirety as follows:
Sec. 2-247. Membership; term.
(a) The authority shall consist of commissioners selected by the City Council in
the manner provided in either Subsection (1) or (2) of this Section.
(1) The City Council may provide that its members shall ex
officio be appointed the commissioners of the authority, in which
event the terms of office of such commissioners shall be coterminous
with their terms of office on the City Council. Under this method of
selection,the Mayor and Mayor Pro Tem shall be ex-officio the chair
and vice-chair, respectively, of the commissioners.
(2) Alternatively, the authority shall consist of seven (7)
commissioners appointed as set forth in Section 29-4-205, C.R.S.
One (1) of such commissioners may be a city official. Under this
method of appointment, each commissioner shall serve without
compensation for a term of five (5) years. No commissioner shall
serve more than two (2) full, consecutive terms.
