OF THE COUNCIL OF THE CITY OF FORT COLLINS
ADJUSTING THE CAPITAL IMPROVEMENT EXPANSION AND
NEIGHBORHOOD PARKLAND FEES FOR INCREASES IN INFLATION BASED
ON THE DENVER-BOULDER CONSUMER PRICE INDEX
WHEREAS,the City of Fort Collins is a home rule municipality having the full right of self-
government in local and municipal matters under the provisions of Article XX, Section 6 of the
Colorado Constitution; and
WHEREAS, among the home rule powers of the City is the power to regulate, as a matter
of purely local concern, the development of real property within the City; and
WHEREAS, the City of Fort Collins' Comprehensive Plan shows that the rate of future
growth and development in Fort Collins will require a substantial expansion in capital library,
community park,police,fire,and general government facilities,and related capital equipment,if its
level of service standards for such facilities are to be maintained; and
WHEREAS, the City Council has determined that future growth and new development
should contribute its proportionate share of providing such capital improvements; and
WHEREAS,the City Council has broad legislative discretion in determining the appropriate
funding mechanisms for financing the construction of public facilities in the City; and
WHEREAS, based on the foregoing, the City Council adopted Ordinance No. 51, 1996,
establishing certain capital improvement expansion fees. and
WHEREAS, Section 7.5-18 of the City Code provides for annual fee increases in the capital
improvement expansion fees corresponding to the increases in the Denver-Boulder Consumer Price
Index for all urban consumers; and
WHEREAS, in September, 1968, Council adopted Ordinance No. 38, 1968, which
established the original neighborhood parkland fee,to fund the acquisition and development of park,
and which has since been amended on several occasions to adjust the fee and refine related
procedures and requirements; and
WHEREAS, with the adoption in August, 1993, of Ordinance No. 82, 1993, the Council
directed the City manager to annually review the Neighborhood Parkland Fee and submit to the
Council proposed inflation-related increases based on the Denver-Boulder Consumer Price Index;
and
WHEREAS, on August 20, 1996, Council adopted Ordinance No. 105, 1996, which
conformed the Neighborhood Parkland fee to the housing size differentials in the Capital
Improvement Expansion Fee ordinance, and updated to reflect pre-1996 inflation; and
WHEREAS, the Bureau of Labor Statistics has released its most recent Denver-Boulder
Consumer Price Index for all urban consumers, and that Index reflects an inflation increase of 7.32
percent since the end of 1995; and
WHEREAS,Council adopted Ordinance No. 172, 1997,adjusting the Capital Improvement
Expansion Fees on second reading on November 4, 1997, to reflect that rate of inflation; and
WHEREAS,two of the Fire Protection Capital Improvement Expansion Fee rates were not
revised to reflect the correct inflation adjustment.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the fee schedule in Section 7.5-30(a) of the Code of the City of Fort Collins,
establishing the Fire Protection Capital Improvement Expansion Fee, be amended nunc pro tunc,
January 1, 1998, as follows:
Sec. 7.5-30. Fire protection capital improvement expansion fee.
(a) There is hereby established a fire protection capital
improvement expansion fee which shall be imposed pursuant to the
provisions of this Article for the purpose of funding capital
improvements related to the provision of fire services, as such
improvements may be identified in the capital improvements plan for
fire protection services. Such fee shall be payable prior to the
issuance of any building permit for a residential, commercial or
industrial structure. The amount of such fee shall be determined as
follows:
Residential buildings (per
dwelling unit)
700 sq. ft. and under $ 78.00
701 to 1200 sq. ft. 111.00
1201 to 1700 sq. ft. 130.00
1701 to 2200 sq. ft. 149.00
2201 sq. ft. and over 181.00
Commercial buildings
(per 1000 square feet) 160.00
Industrial buildings
(per 1000 square feet) 44.00
In the case of duplexes and multifamily structures, the amount of the fee for each
dwelling unit shall be based upon the average size of the dwelling units contained
within each such structure.
