OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE AND
AUTHORIZING THE TRANSFER OF APPROPRIATIONS
TO BE USED FOR THE CONSTRUCTION OF THE SECOND
SEGMENT OF THE HARMONY ROAD BIKEWAY PROJECT
WHEREAS, on October 1, 1996, the City Council adopted Ordinance No. 123, 1996,
appropriating a total of$255,180, in the form of Intermodal Surface Transportation Enhancement
Act(ISTEA)funds from the Colorado Department of Transportation(CDOT)and prior year reserves
in the Transportation Services Fund to be used for the construction of the first segment of the
Harmony Road Bikeway project(the "Project"); and
WHEREAS,constructing bike lanes along Harmony Road from Timberline Road to County
Road 9 was identified as the highest priority of phase 1 of the Project; and
WHEREAS, a the portion of the aforementioned bike lane segment from Timberline Road
to Corbett Drive has been completed and the remaining portion from Corbett Drive to County Road
9 will be completed as part of the Symbios Logic project; and
WHEREAS,the City Council adopted Resolution 98-85, on May 19, 1998, authorizing the
City to enter into an intergovernmental agreement with the Colorado State Department of
Transportation for the receipt of Intermodal Surface Transportation Enhancement Act funds to be
used to construct improvements relating to phase II of the Harmony Road Bikeway project; and
WHEREAS, the Colorado Department of Transportation has made available to the
City of Fort Collins, ISTEA funds in the total amount of$93,600 to proceed with the construction
of phase II of the Project, including providing bike lanes on the south side of Harmony Road from
College Avenue to Boardwalk Drive, and on the north and south sides of Harmony Road between
McMurry Drive and Timberline Road; and
WHEREAS, the estimated cost to complete phase II of the Project is $117,000; and
WHEREAS,local matching funds needed for phase II of the Project,totaling$23,400,have
been appropriated and are available in the Transportation Services Fund, Transportation Planning
1998 budget; and
WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations, in conjunction with
all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpended appropriated amount or portion thereof from one fund or capital project
to another fund or capital project, provided that the purpose for which the transferred funds are to
be expended remains unchanged; and
WHEREAS, it is the desire of the Council to appropriate the sum of$93,600 in Colorado
Department of Transportation ISTEA funds and authorize the transfer of$23,400 in local matching
funds in the Transportation Services Fund to be used to construct phase II of the Harmony Road
Bikeway project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Transportation Services Fund,the sum of NINETY-THREE THOUSAND SIX HUNDRED
DOLLARS ($93,600) from Colorado Department of Transportation Intermodal Surface
Transportation Enhancement Act funds, to be used to construct phase II of the Harmony Road
Bikeway project.
Section 2. That the unexpended appropriated amount of TWENTY-THREE
THOUSAND FOUR HUNDRED DOLLARS ($23,400) is hereby authorized for transfer from
operations dollars in the Transportation Planning 1998 budget to the Harmony Road Bikeway project
to be used for the construction of phase II of said project.
