OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CAPITAL PROJECTS FUND AND PRIOR YEAR RESERVES IN
THE SALES AND USE TAX FUND AND AUTHORIZING THE TRANSFER
OF APPROPRIATIONS BETWEEN FUNDS TO BE USED FOR THE
PRELIMINARY DESIGN AND CONSTRUCTION OF A DOWNTOWN TRANSIT CENTER
WHEREAS, in 1995, the City began earmarking funds for land acquisition and
implementation of the Civic Center Plan and the General Government Services Strategic Facility
Plan; and
WHEREAS,one of the components of the aforementioned plans is design and construction
of a downtown transit center(the "Transit Center"); and
WHEREAS, preliminary plans call for the Transit Center to be developed through the
renovation of the Colorado & Southern Freight Depot located on Block 22, along with site
improvements for transit busses and two additional building pads; and
WHEREAS,the preliminary cost estimates for design and construction of the Transit Center
is $1,270,900, including a reserve for Art in Public Places, totaling $12,709; and
WHEREAS, staff has identified available funds in the amount of$90,900 in the Sales and
Use Tax Fund,Use Tax Carryover Reserve,$80,000 from the Building Community Choices,Mason
Street Transportation Corridor project for conceptual and preliminary design only,and the remaining
funds for the Transit Center project to be available from transfers from the Civic Center Parking
Structure ($600,000) and Office Building ($500,000) capital projects of funds representing the
payment to the City of the value of the real property for those two projects, in Ordinance No. 141,
1998, and Ordinance No. 142, 1998, respectively; and
WHEREAS,in April 1997,the voters of the City of Fort Collins approved a one-quarter cent
sales and use tax to fund the construction of certain capital improvement projects identified in
Ordinance No. 30, 1997; and
WHEREAS, Ordinance No. 30, 1997, includes a project which funds the Mason Street
Transportation Corridor project, Phase 1 and 2, at an estimated cost of$5,500,000 (1996 dollars),
which includes as part of Phase 1 the engineering and design of the Mason Street Transportation
Corridor, including a transit center to be located at the north end of the Corridor; and
WHEREAS, the use of funds in the Building Community Choices, Mason Street
Transportation Corridor project for the conceptual and preliminary design of the Transit Center on
Block 22 is consistent with the terms of Ordinance No. 30, 1997, and the preliminary plans for the
Mason Street Transportation Corridor project, as referenced therein; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in conjunction with
all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and
anticipated revenue to be received during the fiscal year; and
WHEREAS,Article V,Section 9,of the Charter also permits the City Council to appropriate
by ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated; and
WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpended appropriated amount or portion thereof from one fund or capital project
to another fund or capital project, provided that the purpose for which the transferred funds are to
be expended remains unchanged; and
WHEREAS, pursuant to Section 23-304 of the City Code, one percent (1%) of the funds
appropriated for the construction of capital projects should be set aside in the Art in Public Places
Reserve Account in the Cultural Services and Facilities Fund, for use in the acquisition or leasing
of works of art, maintenance,repair or display of works of art, and administrative expenses related
to the Art in Public Places Guidelines adopted by Council in Ordinance No. 47, 1998; and
WHEREAS,it is the desire of the Council to appropriate$1,100,000 in unanticipated revenue
in the Capital Projects Fund,representing transfers from the Parking Structure and Office Building
capital projects, $90,900 from prior year reserves in the Sales and Use Tax Fund for transfer to the
Capital Projects Fund, authorize the transfer of existing appropriations, totaling $80,000, from the
Building Community Choices, Mason Street Transportation Corridor project to be used for
conceptual and preliminary design of the Transit Center. and provide funding for the City's Art in
Public Places Program by authorizing the transfer of$12,709 from the Transit Center capital project
to the Art in Public Places Reserve Account in the Cultural Services and Facilities Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in
the Capital Projects Fund, Transit Center capital project, contingent upon the final approval of
Ordinance No. 141, 1998, and Ordinance No. 143, 1998, the sum of ONE MILLION ONE
HUNDRED THOUSAND DOLLARS($1,100,000)representing transfers from the Capital Projects
Fund, Parking Structure project ($600,000) and Office Building project ($500,000) to be used for
the preliminary design and construction of the Transit Center.
Section 2. That there is hereby appropriated for expenditure from prior year reserves in the
Sales and Use Tax Fund, the sum of NINETY THOUSAND NINE HUNDRED DOLLARS
($90,900) for transfer to the Capital Projects Fund, Transit Center capital project and appropriated
therein to be used for the preliminary design and construction of the Transit Center.
Section 3. That the unexpended appropriated amount of EIGHTY THOUSAND DOLLARS
($80,000) is hereby authorized for transfer from the Building Community Choices, Mason Street
Transportation Corridor capital project to the Capital Projects Fund, Transit Center capital project
and appropriated therein to be used for the preliminary design of the Transit Center.
Section 4. That the unexpended appropriated amount of TWELVE THOUSAND SEVEN
HUNDRED NINE DOLLARS ($12,709) is hereby authorized for transfer from the Transit Center
capital project in the Capital Projects Fund to the Art in Public Places Reserve Account in the
Cultural Services and Facilities Fund,and appropriated therein to be used for art associated with the
design and construction of the Transit Center.
