OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE
UTILITY EASEMENT FOR GAS SERVICE
TO PUBLIC SERVICE COMPANY OF COLORADO
WHEREAS, the City of Fort Collins is the owner of the land and buildings known as The
Mulberry Water Reclamation Facility (MWRF) located at 900 Riverside Avenue in Larimer County,
Colorado; and
WHEREAS, the City of Fort Collins desires to transfer the heating systems at MWRF to
natural gas; and
WHEREAS, Public Service Company of Colorado needs a non-exclusive easement as
described on Exhibit "A", attached hereto and incorporated herein by this reference, to construct,
operate, maintain, repair and replace a utility line to provide gas service at MWRF, which easement
will not materially affect the Water Utility's use of its 900 Riverside Avenue property; and
WHEREAS, Section 23-1 11 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City, provided the Council first
finds by ordinance that any sale or disposition of real property owned by the City will not materially
impair the viability of the utility system as a whole if the property is part of the system and that the
sale is in the best interest of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the above described sale and conveyance of a non-exclusive easement
is in the best interest of the City of Fort Collins.
Section 2. That the above-described conveyance of a non-exclusive easement will not
materially impair the viability of the Water Utility as a whole.
Section 3. That the Mayor is authorized to execute a Public Service Company of
Colorado Utility Easement Agreement conveying a non-exclusive easement for gas service to Public
Service Company of Colorado.

A 10' wide utility easement being located on, over and across a portion of Wastewater Treatment
Plant No.I and Lot 1, Springer Third Filing on file at the Clerk and Recorder, Larimer County,
Colorado, located in the Southeast Quarter of Section 12, Township 7, North, Range 69 West of the
6th Principal Meridian, City of Fort Collins, County of Latimer, State of Colorado, being more
particularly described as follows:
That portion of a utility easement 10 feet in width with foreshortened and prolonged sidelines so as
to meet the East property line of said Wastewater Treatment Plant No.l and shall be 5 feet each side
measured at right angles and parallel with the centerline described as follows:
