OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE SALE OF A 2.5 ACRE PORTION OF THE
CITY STREETS SITE ON EAST VINE DRIVE TO THE COLOR-ADO
DEPARTMENT OF TRANSPORTATION
WHEREAS, the City of Fort Collins is the owner of that certain parcel of real property
located at 625 Ninth Street, Fort Collins, Larimer County, Colorado, known as the East Vine Streets
Facility; and
WHEREAS, a 2.5 acre portion of this property is described on Exhibit "A", on file in the
office of the City Clerk, and incorporated herein by this reference (the "Property"); and
WHEREAS, the Colorado Department of Transportation ("CDOT") desires to relocate its
services to the Property from its existing site at 610 East Vine Drive (the "CDOT Property"); and
WHEREAS, the sale of the Property will not interfere with the City's continued use of the
East Vine Streets Facility; and
WHEREAS, the City has a planned project to extend Redwood Street which requires the
acquisition of a portion of the CDOT Property; and
WHEREAS,the Property is valued at$179,685 and the portion of the CDOT Property to be
acquired by the City, consisting of approximately .8 acres, is valued at $90,216; and
WHEREAS, City staff has negotiated an agreement with CDOT that provides for the
exchange of these properties and CDOT has agreed, in addition, to pay the City the difference in
values of the properties, or$89,469; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City, provided the Council first
finds by ordinance that any sale or other disposition of real property owned by the City is in the best
interest of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the exchange of the Property and the above described CDOT Property,
with additional compensation to the City in the amount of$89,469, is in the best interest of the City
of Fort Collins.
Section 2. That the City Manager be, and hereby is, authorized to execute such
conveyance documents he determines necessary and appropriate, in consultation with the City
Attorney, by which the City shall sell and convey the Property to CDOT on terms and conditions
consistent with this Ordinance.
Introduced, considered favorably on first reading, and order ublished this 16th. day of
December,A.D. 1997, and to be presented for final passage on ld'6th day of Janua A.D. 1998.
