OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 2, ARTICLE IV OF THE CITY CODE
PERTAINING TO ADMINISTRATIVE ORGANIZATION
WHEREAS,under Article II, Section 5(b) and Article IV, Section 2 of the City Charter, the
City Council has the power to establish, change, consolidate or abolish administrative offices,
departments or agencies by ordinance upon report and recommendation of the City Manager, so long
as the administrative functions and public services established by the Charter are not abolished in
any such reorganization; and
WHEREAS, under Article IV, Section 2 of the City Charter, administrative functions and
duties may be assigned and distributed among those offices,departments and agencies by regulations
issued by the City Manager; and
WHEREAS,the term"departments"as used in said provisions, is defined by the Charter and
Code to mean "major city administrative unit(s) headed by a director"; and
WHEREAS, the administrative organization of the City has been established by the City
Council through the adoption of Chapter 2, Article IV of the Code, and consists of eight major
administrative service areas, each of which is headed by a director; and
WHEREAS, said Chapter 2, Article IV of the City Code does not presently include any
reference to the Office of the City Manager,the Office of the City Attorney, or the Municipal Court;
and
WHEREAS, upon the report and recommendation of the City Manager, the City Council
believes it to be in the best interests of the City to amend Chapter 2, Article IV of the City Code to
include references to the foregoing offices and their respective duties and functions.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Chapter 2, Article IV, of the Code of the City of Fort Collins shall be
amended by the addition of a new Division 2, which shall read in its entirety as follows:
DIVISION 2. OFFICE OF THE CITY MANAGER
Sec. 2-476. City Manager; duties.
The Office of the City Manager shall be under the direction of the City
Manager who shall be responsible to the City Council for the proper administration
of all affairs of the city and who shall have all powers and duties assigned to the City
Manager by the provisions of the Charter and this Code. The offices and divisions
of the Office of the City Manager shall be established by the City Manager. Said
offices and divisions, and the employees assigned thereto, shall be responsible for
such duties and functions as may be determined by the City Manager, provided that
such duties and function are consistent with the administrative organization of the
City as established by the provisions of the Charter and this Code.
Section 2. That existing Divisions 2 through 9 of Article IV, Chapter 2 of the City Code
shall be renumbered as Divisions 3 through 10 respectively, and the sections contained therein
renumbered accordingly.
Section 3. That Chapter 2, Article IV of the Code of the City of Fort Collins shall be
further amended by the addition of new Divisions 11 and 12, which shall read in their entirety as
follows:
DIVISION 11. OFFICE OF THE CITY ATTORNEY
Section 2-556. City Attorney; duties.
The Office of the City Attorney shall be in the charge of the City Attorney
who is directly and solely responsible to the City Council and who shall be
responsible for the functions and duties of the Office of the City Attorney.
DIVISION 12. MUNICIPAL COURT
Section 2-561. Municipal Judge; duties.
The Municipal Court shall be in the charge of the Municipal Judge, who is
directly and solely responsible to the City Council and who shall be responsible for
the functions and duties of the Municipal Court.
