OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 25 OF THE CODE OF THE CITY OF
FORT COLLINS REGARDING TAX AND UTILITY REBATES
WHEREAS, the City Council has determined that it is in the best interest of the City to
provide property tax, utility, and sales tax rebate programs for low-income, elderly, and disabled
residents of the City to provide some financial relief to those members of the population who may
have difficulty paying routine bills and to help make the cost of food and housing more affordable
to these residents; and
WHEREAS,the gross income limits for all rebate programs were changed in 1997 to match
those used by the City's HOME Program and to provide consistency among City programs; and
WHEREAS, income limits should be automatically adjusted annually to reflect changes in
the area median income; and
WHEREAS,the automatic adjustment of income limits set forth in this Ordinance shall also
operate to cause the automatic adjustment of such limits by reference to Section 25-29 for the Water,
Wastewater,Stormwater,Electric Utilities Refund Program,set forth in Section 26-612 of the Code;
and
WHEREAS, an increase to the income limits is anticipated to have a minimal financial
impact; and
WHEREAS, an additional $21,000 was unspent in the 1997 rebate year; and
WHEREAS, the sales tax rebate has been set at $25 per person since 1972, and staff has
recommended that the rebate amount be adjusted to $40, to reflect the increase in the cost of living
since that time.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 25-29(4) of the Code of the City of Fort Collins, regarding Ad
Valorem Tax Refunds, be amended to read as follows:
See. 25-29. Qualifications.
(4) The applicant household shall have an annual income which shall not
exceed thirty percent (30%) of the area median income for the
applicable household size in the Fort Collins-Loveland metropolitan
statical area, rounded to the nearest two hundred and fifty dollar
($250) increment, up to a maximum household income of thirty
percent(30%)of the area median income for a household of four(4),
as most recently published by the United States Department of
Housing and Urban Development as of August 1 of the rebate year.
Section 2. That Section 25-49(1)of the Code of the City of Fort Collins,regarding Sales
Tax Rebate on Food, be amended to read as follows:
See. 25-49. Qualifications.
(1) All members of an applicant household must have resided within the
city prior to the commencement of the calendar year for which
application is made and at the time the application is made.
The applicant household shall have an annual income which shall not
exceed thirty percent (30%) of the area median income for the
applicable household size in the Fort Collins-Loveland metropolitan
statistical area, rounded to the nearest two hundred and fifty dollar
($250) increment, up to a maximum household income of thirty
percent(30%)of the area median income for a household of four(4),
as most recently published by the United States Department of
Housing and Urban Development as of August 1 of the rebate year.
Section 3. That Section 25-50 of the Code of the City of Fort Collins,regarding the Sales
Tax Rebate on Food, be amended to read as follows:
Sec. 25-50. Amount of rebate.
The amount of rebate payable hereunder shall be in the sum of forty dollars($40)
per person per calendar year in any eligible household.
