OF THE COUNCIL OF THE CITY OF FORT COLLINS
DEDICATING .76 ACRES OF LAND TO LARIMER COUNTY FOR
IMPROVEMENTS TO COUNTY ROAD 42C AND .I I ACRES OF LAND
TO PUBLIC SERVICE FOR A NON-EXCLUSIVE UTILITY EASEMENT
WHEREAS, the City of Fort Collins is the owner of certain land adjacent to County Road
42C and known as Pineridge Open Space; and
WHEREAS, Larimer County's "Short Range Highway Improvement Program" includes
improvements to County Road 42C along the east side of Horsetooth Reservoir(the "Project"); and
WHEREAS,Larimer County has requested that the City dedicate .76 acres of land to be used
as public highway in connection with the Project,which land is described on Exhibit"A", attached
hereto and incorporated herein by this reference; and
WHEREAS, in connection with the Project, Larimer County has further requested that the
City also dedicate .I I acres of land to Public Service Company of Colorado for relocation of a non-
exclusive utility easement, which easement is described on Exhibit "B", attached hereto and
incorporated herein by this reference; and
WHEREAS,the Project will benefit the citizens of Fort Collins by improving safe access to
Pineridge Open Space; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City, provided the Council first
finds by ordinance that any sale or disposition of real property owned by the City is in the best
interests of the City of Fort Collins.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. That the above-described sale and conveyance of land is in the best interest
of the City of Fort Collins and furthers the public purpose of improving the safety of public roads
and improving access to Pineridge Open Space.
Section 2. That the Mayor is hereby authorized to execute a Deed of Dedication
dedicating to Larimer County the real property described on Exhibit "A" as a public highway to be
used to improve County Road 42C.
Section 3. That the Mayor is hereby authorized to execute a non-exclusive utility
easement to Public Service Company of Colorado for the relocation of an overhead electrical
distribution across the land as described on Exhibit"B".

LEGAL DESCRIPTION OF PERMANENT ROAD RIGHT OF WAY
CITY OF FORT COLLINS TO LARIMER COUNTY
Property description of a permanent road right of way located in the East half of the northwest
quarter of Section 29, Township 7 North, Range 69 West of the Sixth Principal Meridian, Larimer
County, Colorado described as follows:
Considering the West line of the East half of the northwest quarter of said section as bearing North
00°20'50" West and with all bearings contained herein relative thereto. Commencing at a point on
the West line of the East half of the northwest quarter of said section from which point the West
sixteenth corner between Section 20 and said Section 29 bears North 00°20'50"West, 190.92 feet,
said point being the centerline of a road right of way described in deed recorded in Book 1193,Page
539 on file in the Office of the Clerk and Recorder of Larimer County; thence departing from said
West line and along said centerline the following six courses; South 18'11'50" East, 526.14 feet to
the beginning of a curve concave to the northeast having a central angle of 23°24'30" and radius of
