OF THE COUNCIL OF THE CITY OF FORT COLLINS
CONSENTING TO THE CONSTRUCTION OF CERTAIN
WATER AND SEWER FACILITIES UPON PROPERTY LYING
PARTLY WITHIN THE BOUNDARIES OF THE CITY,
THROUGH THE FORMATION OF A
LARIMER COUNTY SPECIAL IMPROVEMENT DISTRICT
WHEREAS, Larimer County, Colorado (the "County") , may be desirous of
forming a special improvement district (the "District") pursuant to
Colorado statute for the purpose of financing and constructing certain
water and sewer improvements to facilitate development near the
intersection of County Roads 52 and 11 ; and
WHEREAS, a portion of the improvements to be included in the District
would lie within the corporate boundaries of the City of Fort Collins,
Colorado (the "City") , and Section 30-20-603(1) (a) , C.R.S. , requires the
consent of the City by ordinance before such improvements could be
constructed through a county special improvement district; and
WHEREAS, it is the opinion of the City Council of the City that the
construction of such improvements as part of the proposed District would be
in the best interests of the City and the Council desires to consent to the
same; and
WHEREAS, by passage of this Ordinance, the Council does not intend
that the City participate in any of the costs of street improvements within
the District; and
WHEREAS, by passage of this Ordinance, the City Council does not
intend that any subsequent development of property within the City be
exempt from compliance with all then-applicable City water and sewer
standards and requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City hereby consents to the construction of water and
sewer improvements upon property partially within the corporate boundaries
of the City, as shown on Exhibit A, attached hereto and incorporated herein
by this reference, through the formation of a Larimer County special
improvement district.
Introduced, considered favorably on first reading, and ordered
published this 1st day of March, A.D. 1988, and to be presented for final
passage on the 15th day of March, A.D. 1988.
