OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE CODE OF THE CITY OF FORT COLLINS
TO ESTABLISH THAT THE BUILDING REVIEW BOARD SHALL
SERVE AS THE BOARD OF APPEALS FOR THE ADMINISTRATION OF
THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS
WHEREAS, pursuant to Section 5-46 of the Code of the City, the City has adopted the
Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition(the "Code"); and
WHEREAS,pursuant to Section 205 of the Code, the City Council must appoint a"Board
of Appeals" to provide the final interpretations of the provisions of the Code and to hear appeals
provided for thereunder; and
WHEREAS, the Council has determined that Building Review Board of the City should
serve as said Board of Appeals.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Article II, Division 3 of the Code of the City of Fort Collins is hereby
amended by renumbering the existing Section 5-47 as Section 5-48 and by the addition of a new
Section 5-47 to read as follows:
See. 5-47. Amendments and Deletions to Code.
The Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition,
adopted herein is hereby amended and changed in the following respects:
(1) Section 205 is amended to read as follows:
In order to provide for final interpretation of the provisions of this Code and
to hear appeals provided for hereunder, there is hereby established a Board
of Appeals consisting of the Building Review Board as established by §2-
117 of the Code. The Building Official shall be an ex officio member of and
shall act as Secretary to said Board. The Board shall adopt reasonable rules
and regulations for conducting its business and shall render all decisions and
findings in writing to the appellant with a copy to the Building Official.
Appeals to the Board shall be processed in accordance with the provisions
contained in Section 501 of this Code. Copies of all rules or regulations
adopted by the Board shall be delivered to the Building Official who shall
make them freely accessible to the public.
Section 2. That Section 2-119 of the Code of the City of Fort Collins is hereby amended to
read as follows:
Sec. 2-119. Functions.
The board shall have the following functions:
(1) To determine the suitability of alternate materials or alternate methods of
construction,provide for reasonable interpretations of the provisions of the
city building code, city mechanical code, and city fire code, and hear all
appeals made to it related to such codes;
(2) To hear all requests for variances from the requirements of Article 5, Title
9, C.R.S., which establishes standards and specifications governing the
accessibility of buildings and facilities within the city to the physically
handicapped;
(3) To hear all matters related to the suspension or revocation of any supervisor
certificate or license or registration of any plumber or electrician as provided
in the Code;
(4) To,upon appeal in specific cases, grant variances from the terms of Chapter
15, Article V, where the strict application of any provision of said Article
would result in peculiar or exceptional practical difficulties to or exceptional
or undue hardship upon the person regulated, provided that such relief may
be granted without substantial detriment to the public good and without
substantially impairing the intent and purposes of said Article; and
(5) To serve as the Board of Appeals as required under Section 205 of the
Uniform Code for the Abatement of Dangerous Buildings. Decisions made
by the Building Review Board as the Board of Appeals under this subsection
(5) shall be appealable to the City Council pursuant to Chapter 2, Article II,
Division 3 of the Code.
