OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A RIGHT-OF-WAY AND AUTHORIZING THE
MAYOR TO EXECUTE A QUITCLAIM DEED
CONVEYING THE INTEREST OF THE
CITY OF FORT COLLINS IN CERTAIN LANDS
ADJACENT TO WARREN LAKE RESERVOIR
WHEREAS, the Warren Lake Reservoir Company previously deeded certain
property to the City for the relocation and reconstruction of Lemay Avenue
adjacent to Warren Lake; and
WHEREAS, at the time of such construction, the alignment of Lemay
Avenue was shifted, resulting in an unused portion of the original road
right-of-way; and
WHEREAS, the Warren Lake Reservoir Company has requested that the City
of Fort Collins vacate by ordinance and relinquish by quitclaim deed any
claim to the unused portion of right-of-way and land adjacent to Warren
Lake; and
WHEREAS, City agencies and utility companies have been contacted and
report no problems with the proposed vacation and deed; and
WHEREAS, there will be no costs to the City in making the proposed
vacation and deed; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation and deed; and
WHEREAS, the City Council finds that said property is not intended to
be used for municipal purposes or secured for the purpose of being used for
municipal purposes and it is for the best interests of the City that the
property be conveyed to the Warren Lake Reservoir Company.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That a portion of the right-of-way dedicated for roadway
purposes for Lemay Avenue (County Road 13) adjacent to Warren Lake, which
portion is more particularly described on Exhibit A, attached hereto and
incorporated herein by this reference, be, and the same hereby is, vacated,
abated and abolished.
Section 2. That the Mayor be, and he hereby is, authorized to execute
a quitclaim deed conveying to the Warren Lake Reservoir Company whatever
residual ownership interest the City may have in that real property as
described on Exhibit A.
Introduced, considered favorably on first reading, and ordered
published this 15th day of November, A.D. 1988, and to be presented for
final passage on the 6th day of December, A.D. 198 .
