OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE AFFIDAVIT OF PETITION CIRCULATOR OF THE
GENERAL FORM FOR PETITIONS FOR MEASURES SOUGHT TO BE
INITIATED OR REFERRED TO THE VOTE OF THE ELECTORS OF
THE CITY OF FORT COLLINS, AND FOR PETITIONS FOR
RECALL OF INCUMBENTS OF ELECTIVE OFFICES
WHEREAS, on March 3, 1987, the voters of the City of Fort Collins
adopted amendments to the City Charter relating to the initiative and
referendum process and the process for recall of elected officials; and
WHEREAS, pursuant to Section 4(b) (1) of Article X of the Charter, the
City Council is to prescribe by ordinance, upon recommendation of the City
Clerk, a general form of petition for initiative and referendum; and
WHEREAS, on May 19, 1987, the Council did prescribe a general form of
petition for circulation and filing by petitioners for each measure sought
to be initiated or referred to the vote of the electors and for recall of
elected officials; and
WHEREAS, the Supreme Court of the United States has handed down a
ruling which overrides the Fort Collins Charter provision which prohibits
payments to petition circulators; and
WHEREAS, the general form of petition for initiative, referendum, and
recall must be amended to comply with the Supreme Court's ruling; and
WHEREAS, it is also desirable to clarify the City Clerk's use of the
general petition form so as to permit the periodic modification of its
heading to indicate whether the form is being used for an initiative, a
referendum, or a recall election.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1 . That the affidavit of petition circulator of the general
form of "Petition for Initiative, Referendum, or Recall ," shall be amended
by deleting the existing reference to the payment of circulators. The
revised page shall include a revision date of October 18, 1988. Said form
of petition shall thereafter be available for public inspection and
distribution in the office of the City Clerk.
Section 2. That the City Clerk is hereby authorized to modify the
heading of the general form of petition as needed for each initiative,
referendum, or recall to more clearly identify the purpose of the petition
by deleting, as appropriate, the inapplicable portions of the heading,
thereby making the form of the petition specific as to each such
initiative, referendum or recall .
Section 3. That the City Clerk be, and hereby is, directed to have a
sufficient quantity of amended petition forms reprinted for distribution,
upon request, to any individual or group that has filed notice of intent
with the City Clerk to submit an initiative, referendum or recall petition
in accordance with the provisions of the City Charter.
Introduced, considered favorably on first reading, and ordered
published this 18th day of October, A. D. 1988, and to be presented for
final passage on the 1st day of November, A.D. 8.
