CALLING A SPECIAL MUNICIPAL ELECTION TO BE
HELD IN CONJUNCTION WITH THE NOVEMBER 5, 1996
GENERAL ELECTION AND SUBMITTING
A BALLOT MEASURE TO A VOTE OF THE
REGISTERED ELECTORS OF THE CITY
WI IEREAS,Article X, Section 3 of the Charter of the City of Fort Collins provides that the
City Council may,without petition therefor, submit any proposed ordinance to the vote of the people
at a special election ; and
WHEREAS, on June 18, 1996 Council adopted Resolution 96-74, expressing an intent to
place on a November, 1996 special election ballot a measure authorizing the retention of revenues
in excess of constitutional revenue and spending limits; and
WHEREAS,the City Council wishes to call a special municipal election for that purpose on
November 5, 1996, in conjunction with the General Election.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That a Special Municipal Election in the City of Fort Collins is hereby called for
Tuesday,November 5, 1996, which shall be held in conjunction with the Latimer County, Slate of
Colorado, General Election at such polls as are regularly established and announced for such
elections.
Section 2. That the polls shall be open at the hour of 7:00 a.m. and shall remain open
continuously until and shall be closed at 7:00 p.m.
Section 3. That said Special Election shall be held and conducted, as nearly as may be, in
the manner prescribed by law, as in the case of regular city elections conducted pursuant to the
Charter of the City of Fort Collins and the Statutes of the State of Colorado.
Section 4. That the provisions of the Uniform Election Code of 1992 are hereby adopted
with respect to the conduct of said election in lieu of the provisions of the Municipal Election Code
of 1965.
Section 5. That the use of an electronic system to record the votes at said election is hereby
authorized.
Section 6. That no vote, either for or against any ballot issues referred or submitted, shall
be received by the election judges unless the person offering the same shall be a duly registered voter
in the precinct in which lie or she offers to vote and, in addition thereto, said person is an elector of
the City of Fort Collins as defined in the applicable election laws.
Section 7. That the City Clerk is hereby directed to certify the ballot content for the Special
Municipal Election to the Larimer County Clerk no later than September 10, 1996.
Section 8. That the Mayor and City Clerk are hereby authorized to enter into an
intergovernmental agreement with Larimer County for conduct of the election.
Section 9. That there is hereby submitted to the registered electors of the City of Fort Collins
at the Special Election to be held in the several precincts of the City on Tuesday,November 5, 1996,
the Proposed Ordinance set out as follows:
ORDINANCE NO. 100, 1996
OF THE COUNCIL OF THE CITY OF FORT COLLINS
PROVIDING FOR THE APPROPRIATION OF $764,000 OF
REVENUE COLLECTED IN 1995, WHICH IS REVENUE ABOVE THE
REVENUE AND SPENDING LIMITS IMPOSED BY ARTICLE X, SECTION 20 OF
THE COLORADO CONSTITUTION, TO BE EXPENDED FOR THE PURPOSES OF
STREET IMPROVEMENTS AND REPAIR, SNOW REMOVAL AND DE-ICING OF
STREETS, AND CONSTRUCTION OF SIDEWALK IMPROVEMENTS TO PROMOTE
PEDESTRIAN SAFETY
WHEREAS, Article X, Section 20 of the Colorado constitution imposes limits on the
rate at which revenue and spending may grow from year to year, and
WHEREAS, Article X, Section 20 provides that voters of the City may approve the
retention of any revenue that is above such growth limits; and
WHEREAS, in 1995, the City collected approximately $764,000 in revenue that is
above the growth limits imposed under Article X, Section 20.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the City Council shall authorize, by ordinance, the appropriation and
expenditure of up to $764,000 of revenue collected in 1995 that is above the revenue and
spending limits imposed by Article X, Section 20 of the Colorado constitution.
Section 2. That said revenue shall be expended for the following purposes: (1)
constructing and repairing streets, (2) removing snow and de-icing streets, and (3)
constructing sidewalks to promote pedestrian safety.
Section 10. That said Proposed Ordinance is hereby submitted to the registered electors of
the City of Fort Collins at said Special Election in substantially the form as set out below:

CURRENTRATE OF CITY TAXES) TORETAIN, ASA VOTER APPROVED REVENUE CHANGE,
THE SUM OF $764,000, AND TO SPEND THAT SUM FOR THE PURPOSES OF (1)
CONSTRUCTING AND REPAIRING STREETS, (2) REMOVING SNOW AND DE-ICING
STREETS,AND (3) CONSTRUCTING SIDEWALKS TO PROMOTE PEDESTRIAN SAFETY. THIS
REVENUE WAS COLLECTED BY THE CITY IN 1995 AND IS ABOVE THE REVENUE AND
SPENDING LIMITS ESTABLISHED UNDER ARTICLE X, SECTION 20 OF THE COLORADO
CONSTITUTION
