OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING VARIOUS SECTIONS OF THE CODE OF THE
CITY OF FORT COLLINS RELATING TO THE CONSOLIDATION OF
THE OFFICE OF ELECTRIC UTILITY SERVICES AND
THE OFFICE OF WATER, WASTEWATER AND STORMWATER UTILITY SERVICES
WHEREAS, on November 17, 1998, City Council approved Ordinance No. 198, 1998, on
second reading, consolidating the Office of Electric Utility Services and the Office of Water,
Wastewater and Stormwater Utility Services; and
WHEREAS,as a consequence,the City's current General Manager ofthe Electric Utility and
the current General Manager of the Office of Water, Wastewater and Stormwater Utility Services
are now one and the same, the General Manager of Utility Services; and
WHEREAS, the Office of the Electric Utility and the Office of Water, Wastewater and
Stormwater Utility is now consolidated as the Office of Utility Services; and
WHEREAS, to accomplish this reorganization it is necessary to make the numerous Code
changes that are set forth in this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 22-33 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 22-33. Designation of officers to supervise improvements.
All local improvements shall be constructed under the general direction and control
of the City Manager and in the immediate charge, direction and supervision of the
Director of Community Planning and Environmental Services and,if applicable,the
General Manager of Utility Services or other officer designated for such purpose in
accordance with maps, plans and specifications adopted by the City Council. The
work of construction may be by independent contract or by the city as determined by
the City Council.
Section 2. That Section 22-111 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 22-111. Special assessment bonds authorized.
(b) All such bonds shall be issued upon estimates of the Director of Community
Planning and Environmental Services or, if applicable, the General Manager of
Utility Services approved by the City Council. The Financial Officer shall preserve
a record of the same in a suitable book kept for that purpose.All such bonds shall be
subscribed by the Mayor and countersigned by the Financial Officer with the
corporate seal affixed and attested by the City Clerk. Facsimile signatures may be
used.
Section 3. That Section 10-16 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 10-16. Definitions
Director shall mean the duly appointed General Manager of Utility Services of the
city or the designated representative of the General Manager.
Section 4. That Section 26-1 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-1. Definitions.
General Manager of Utility Services shall mean the General Manager of Utility
Services or the designated representative of such General Manager.
Section 5. That Section 26-21 of the Code o f the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-21. Organization.
(a) The electric utility shall be under the immediate administrative supervision
and control of the Office of Utility Services which shall operate the properties of the
utility in an efficient and economical manner.
(b) The water, wastewater and stormwater utility shall be under the immediate
administrative supervision and control of the Office of Utility Services which shall
operate the properties of the various utilities in an efficient and economical manner.
Section 6. That Section 26-22 of the Code of the City of Fort Collins is hereby
amended to read as follows:

Sec. 26-22. Powers and duties of utility General Manager.
(a) The electric utility shall be headed by the General Manager of Utility Services
who shall be responsible under the City Manager for the immediate supervision of
the electric utility and the design, construction, reconstruction, addition, repair,
replacement, operation and maintenance of the electrical system.
(b) The water,wastewater and stormwater utility shall be headed by the General
Manager of Utility Services who shall be responsible under the City Manager for the
immediate supervision of the water, wastewater and stormwater utilities and the
design, construction, reconstruction, addition, repair, replacement, operation and
maintenance of the water, wastewater and stormwater systems.
Section 7. That Section 26-24 of the Code of the City of Fort Collins is hereby amended
to read as follows:
See. 26-24. Records.
All contracts,records and evidences of title relating to any of the utilities'property
acquired by the city shall be assembled and carefully preserved. The General
Manager of Utility Services and the Financial Officer shall keep and preserve such
other records and prepare such reports concerning the utilities as the City Manager
directs. The City Manager shall keep the City Council advised of the operation,
financial conditions and future needs of the utilities.
Section 8. That Section 26-41 of the Code of the City of Fort Collins is hereby amended
to read as follows:
See. 26-41. Definitions.
Director shall mean the General Manager of Utility Services or the designated
representative of such General Manager.
Section 9. That Section 26-206 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-206. Definitions.
Director shall mean the General Manager ol' Utility Services or the authorized
representative of such General Manager.

Section 10. That Section 26-366 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-366. Definitions.
Director shall mean the General Manager of Utility Services or the designated
representative of such General Manager.
Section 11. That Section 26-391 of the Code of the City of Fort Collins is hereby amended
to read as follows:
See. 26-391. Definitions.
Director shall mean the General Manager of Utility Services or the designated
representative of such General Manager.
Section 12. That Section 26-464 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-464. Residential energy service, schedule R.
(i) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 13. That Section 26-465 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-465. Residential demand service, schedule RD.
Special services. The electric utility is authorized to provide special services and
capabilities which are beyond those required for basic service, provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 14. That Section 26-466 ofthe Code of the City of Fort Collins is hereby amended
to read as follows:

Section 15. That Section 26-467 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-467. General service, schedule GS.
(k) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 16. That Section 26-468 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-468. General service time-of-demand, schedule GST.
(m) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms f-or the provision of such special
services and capabilities.
Section 17. That Section 26-469 ofthe Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-469. General Service 50, schedule GS50.
(n) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the

utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 18. That Section 26-470 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-470. General service 50X, schedule GS50X.
(m) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 19. That Section 26-471 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-471. General service 50 time -of-demand X, schedule GS50TX.
(o) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 20. That Section 26-472 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-472. General service 750, schedule GS750.
(b) Applicability. This schedule applies to customers served at the primary
voltage of the city's electric system, thirteen thousand two hundred/seven thousand
six hundred twenty (13,200/7,620) volts nominal for three-phase power. This
schedule applies only to individual services with an average metered demand of
seven hundred fifty(750)kilowatts or greater.The Director,at his or her option,may
enter into individual, written agreements with customers having an aggregated
connected load of one thousand (1,000) kilowatts or more, which agreements shall

establish the services to be provided and the amount to be charged to such customers.
(n) Special services. The electric utility is authorized to provide special services
and capabilities which are beyond those required for basic service,provided that such
special services and capabilities are described in a written agreement between the
utility and the customer, which agreement shall also set forth the utility charges
associated with the provision of such special services and capabilities. The Director
shall establish the charges and payment terms for the provision of such special
services and capabilities.
Section 21. That Section 26-491 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-491. Definitions.
Director shall mean the duly appointed General Manager of Utility Services or the
designated representative of such General Manager.
Section 22. That Section 26-651 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-651. Conditions for furnishing service.
(a) Any person outside of the city limits desiring to make a connection to one (1)
or both of the city's water and wastewater utilities shall apply to the city for
permission,and connection permits may be issued after review and recommendation
of the Planning and Zoning Board and the Water Board and the approval of the
General Manager of Utility Services. The General Manager may, in his or her
discretion,elect to approve,without the review and recommendation of the Planning
and Zoning Board and Water Board, the application of persons desiring to make a
single connection to one (1) or both of the city's water and wastewater utilities,
provided that such connections do not exceed a tap size of one (1) inch (if a water
tap) and/or four(4) inches (if a wastewater tap). If the General Manager determines
that the application should not be approved without the review and recommendation
of the aforementioned boards,the General Manager shall forthwith seek such review
and recommendation prior to making his or her decision.
