OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE OF
328 WEST MOUNTAIN AVENUE AND 108 NORTH MELDRUM STREET,
FORT COLLINS, COLORADO, TO POUDRE LANDMARKS
FOUNDATION, INC., A NON-PROFIT CORPORATION
WHEREAS, the City of Fort Collins, Colorado (the "City"), is the owner of the properties
located at 328 West Mountain Avenue,known as the Avery House, and 108 North Meldrum Street
Wood Street, known as the Carriage House, Fort Collins, Colorado; and
WHEREAS,Poudre Landmarks Foundation, Inc.,a non-profit corporation,has proposed to
lease Part of Lot 24, all of Lots 25, 26, 27 and the West 12.5 feet of Lot 28, Block 41, City of Fort
Collins, County of Larimer, State of Colorado,together with the vacant alley at the rear of Lots 26,
27, and 28, also known as 328 West Mountain and 108 North Meldrum, (the "City Property")and
pursuant to the terms of a lease agreement, dated October 16, 1998, and on file in the office of the
City Clerk(the "Lease Agreement"); and
WHEREAS,the proposed lease of the City Property would be for the principal purpose of
continuing its restoration activities on the property to provide a house museum with a conservation
area for historic collections, a display of items of historical interest, and historical education to the
citizens of Fort Collins;
WHEREAS, the above-described use of the City Property will advance important policy
objectives of the City and will enhance its historical value; and
WHEREAS, the Lease Agreement provides for a fifteen-year lease term expiring on
December 31, 2013, in exchange for payment of nominal rent in the amount of$1.00 per year and
compliance with certain conditions and restrictions set forth therein; and
WHEREAS,pursuant to Section 23-114 of the Code of the City of Fort Collins,the Council
is authorized to lease any and all interests in real property owned in the name of the City,provided
that Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the proposed lease of the City Property to Poudre Landmarks Foundation,
Inc.,a Colorado Non-Profit Corporation,consistent with the Lease Agreement,is in the best interests
of the City.
Section 2. That the City Manager be and hereby is authorized to enter into the Lease
Agreement with Poudre Landmarks Foundation,together with such additional terms and conditions
as the City Manager, in consultation with the City Attorney, determines to be appropriate or
necessary to protect the interests of the City.
