OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE OF
906 EAST STUART STREET, FORT COLLINS, COLORADO
TO SUNSHINE SCHOOL, A NON-PROFIT CORPORATION
WHEREAS, the City of Fort Collins, Colorado (the "City"), is the owner of the property
located at 906 East Stuart Street, Fort Collins, Colorado; and
WHEREAS, Sunshine School, a Non-Profit Corporation, has proposed to lease 906 East
Stuart Street, which is located in the Northeast 1/4 of the Northeast 1/4 of Section 24, township 7
North, Range 69 West of the 6th P.M. (the "City Property") for the principal purpose of operating
a facility offering child care services with fees to be charged on a sliding scale according to the
income level of the clients of said facility,pursuant to the terms of a lease agreement,dated October
16, 1998, and on file in the office of the City Clerk(the "Lease Agreement"); and
WHEREAS, the above-described use of the City Property will advance important human
services objectives of the City, and the Lease Agreement will permit the continued use of the City
Property,consistent with the objectives of the Community Development Block Grant,to benefit low
income residents of Fort Collins; and
WHEREAS,the Lease Agreement provides for a five-year lease term expiring on December
31,2002, in exchange for payment of nominal rent in the amount of$1.00 per year and compliance
with certain conditions and restrictions set forth therein; and
WHEREAS,pursuant to Section 23-114 of the Code of the City of Fort Collins,the Council
is authorized to lease any and all interests in real property owned in the name of the City,provided
that Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the proposed lease of the City Property to Sunshine School, consistent with
the Lease Agreement, is in the best interests of the City.
Section 2. That the City Manager be and hereby is authorized to enter into the Lease
Agreement with Sunshine School, together with such additional terms and conditions as the City
Manager,in consultation with the City Attorney,determines to be appropriate or necessary to protect
the interests of the City.
