OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 7-88 OF THE CODE OF THE
CITY OF FORT COLLINS RELATING TO THE PROCEDURE FOR
PROTESTING THE ESTABLISHMENT OF COUNCIL DISTRICT BOUNDARIES
WHEREAS,on April 8, 1997,the electorate of the City approved certain amendments to the
City Charter; and
WHEREAS, among such amendments was an amendment to Article II, Section 1(c) of the
Charter pertaining to redistricting; and
WHEREAS,Article II,Section l(c)states that the Council shall provide by ordinance for the
giving of notice of any redistricting proceedings and the manner of protesting such proceedings;and
WHEREAS, on March 17, 1998,Council adopted Ordinance No. 26, 1998,which provided
for the giving of notice of any redistricting proceedings and the manner of protesting such
proceedings; and
WHEREAS,the manner ofprotesting redistricting proceedings was modeled after an existing
Charter provision relating to the protest of the sufficiency of initiative and referendum petitions;and
WHEREAS, the manner of protesting redistricting proceedings is unnecessarily restrictive
in that it requires written protests to be given under oath: and
WHEREAS,the manner of protesting redistricting proceedings requires Council to hear,and
resolve, such protests to later than the date of first reading of the proposed redistricting ordinance;
and
WHEREAS, since any amendments Council may request upon hearing and first reading of
the redistricting ordinance would require staff to research the effect of such amendments, it is
unreasonable to expect that Council will be able to resolve protests by the date of first reading.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 7-88 of the Code of the City of Fort Collins be, and hereby is, amended to
read as follows:
Sec. 7-88. Protest procedure.
Any registered elector desiring to protest the manner of redistricting proposed in
any such redistricting ordinance may file a written protest in the office of the City
Clerk. Said notice of protest shall be filed no less than seven(7)days prior to the date
upon which the proposed redistricting ordinance is to be heard by the City Council
on first reading.The notice of protest shall set forth with particularity the grounds of
the protest. Such protest shall be heard, considered and resolved by the City Council
no later than the date of second reading of the proposed redistricting ordinance.
Introduced, considered favorably on first reading, and ordered published this 1st day of
December, A.D. 1998, and to be presented for final passage on the 15th day of December, A.D.
1998.
